Writing mails is useless, the only responses they give are standard responses. I filled in a survey yesterday. I know almost certainly that they will read those surveys. Furthermore, I filled in my name, telephone number and e-mail with it so they can contact me. I didn´t want to lose more time on translating this topic, so I linked to this topic. In that way, they know this story is on the internet. I also said that I wouldn´t want a replacement Wii if I knew that this was going to happen. I said that I wanted my old Wii-Shop-Channel account back this month or else I won´t buy a single WiiWare game in the future. The last thing I said was that I am a stickler (again, this could be an incorrect English word) and will get my old games back no matter what.

I´m going to depart for vacation this Friday (the 13th), and I come back home the Friday after that, August 20th. I don´t have internet there so the only way to contact me there is by phone. If they haven´t given any response then I am going to post my problem on other sites where are many WiiWare users. What happens after that I´ll see then.

That´s even 3000 points more than expected, now I remember that there was 1 points card for 3000 that my little brother hadn´t given to me. Just to be precise I will change he Topic Title :´).

So that is the list of doom. I made screenshots of my Club Nintendo Account list (although I think they won´t be of any use. I can still see the whole list of games in my Club Nintendo account AARGHH...

I think I am calling them tomorrow based on all reactions here. I will read through all their agreements and articles once more so I´m not easily blown away by a ´But that was what stood in our terms´. And yes, previous time I think I hadn´t been rude enough or better said: I´ve been too nice to them. I already found some flaws in their way of handling and I´m sure they can´t counterattack some of them.

For example: I said clearly in the e-mail I send to them before I sent my Wii in for repairs that they should move the content and if it was not the case they should let me know. In the letter I send with the Wii I asked them again to transfer the content.

They haven´t given any reaction so that contradicts the e-mail (I know that this may sound like Phoenix Wright ).

Another example: They said that replacing was cheaper than repairing, also incorrect...

Oh, yes, before I forget: Thanks guys for all your advice and help you give me. Even if this doesn´t succeed I´m happy that there are some people who think the same way I do.

You will succeed because they're your games. Ignore all that crap about people saying Nintendo just licence you the games (those people will get walked over their whole lives) and that you don't own them. That's just something software companies say so they can charge you again and again for the same software - but as far as retail law goes, if they sell you something they don't have the right to just delete it and say it's because you changed your language settings. You've paid money for it - them "licencing" software to you doesn't give them the right to just take your money for nothing. If you try everything and still no luck, then contact the media - a newspaper or large media website should do it. They're always looking for excuses to pick on large corporations.

Yes.

To clarify: you own the physical hardware of the cartridge, but not the data (the game itself) stored on it. That data is Nintendo's property and as a purchaser of the product you are given a limited license for personal use of the data - in other words, buy the cartridge and you can play the game.

@invmat Good luck with your call, I hope you get your points back. Do you have a Club Nintendo account or any records of your purchases? At least when using a credit card to purchase Nintendo Points, you have bank/credit card records which show the amount paid. Not sure if you get any records for using point cards, but it's best to have as much evidence on your side when confronting customer service/tech support.

I´m 15. I don´t have a creditcard. The evidence I have is my Club Nintendo Account and all my Points Card Codes. I just found the 3000 Points card I missed so now I have them all. That should be enough, I hope. I wrote down all important things so I´m going to call them right now, best of luck...

Edit: I´m hearing SMG soundtrack right now on the phone :´)

No succes, they say that it stands very clearly in the agreement when you connect to the internet. A change in country settings makes it impossible to transfer them, even if it is changed the country settings back correctly.

What makes this even more suspicious was that the guy was talking about ¨24 games¨ as an ´example´. I don´t know or I can´t remember that I was talking about the specific amount of points on the phone. Which makes the chance high that they must have read this topic.

I´m going to contact Nintendo UK by e-mailing them. I´m not going to send letters or phone them because that will cost too much.

I have already switched the country settings to UK three or four times because German translations of videogames are mostly garbage and this was the only possible way to download the english versions of Secret of Mana, TLoZ: ALttP, The Legend of the Mystical Ninja,...

I just don't understand the issue since all downloaded games are connected to the Wii serial number which never changes. And all my downloads are visible in my German Club Nintendo account, too.

If I have to send my Wii to Nintendo for a repair someday and Nintendo refuses to transfer my Virtual Console games to a new Wii I would definitely never buy a Nintendo console again.

Read somewhere that it´s possible to transfer WiiWare and/or VC games to a new console if you send a new Wii to Nintendo together with a police report saying that your original Wii is stolen. Could anybody here confirm that?

I think Nintendo should definitely read this thread! Hell, if I were you I'd send them a link to it. It might shame them into giving you your points back. This is clearly a case where their policy is counter to the language needs of one of it's customers. You purchased the games, there is a traceable record of this. You should get them back. Furthermore, they should also assist you in setting your Wii up so that you can use whatever language you want without effecting anything else. People with different language requirements shouldn't be penalized for this!

are they saying you'd have to send your Wii to the different regional headquarters to get your games back (like if you sent it to the dutch one, they'd restore your dutch games, and if you sent it to the UK one they'd restore your english games, etc.)? because i know i'd totally do that if it meant getting all my games back, lol -- it'd be a pain, sure, but maybe it's worth a shot to get in touch with the UK's customer service and see if they can help you?

I wrote an e-mail to the Nintendo Service Centre in the UK today. I explained everything and copied some parts of the first post here. I hope they are nicer than Nintendo Benelux...

My experience of Nintendo customer service in the UK was bad, getting a refund for Last Ninja 3 took forever.

Amazing how quick companies will take your hard earned cash, but then be so slow to admit their errors or compensate.
Perhaps you can contact a consumer rights organisation for advice? If they can ignor you and keep your money, they probably will... Persistence is required!
