There's more technical difficulties, started again an hour ago.
Realistically, I think this is just the typical Nintendo underestimates demand for a console and ends up surprised when their servers go down due to overload. Of course this time it's likely due to system transfers to New 3DS (XL) so will probably replicate what happened in Christmas 2013.

I think the most likely update is the Smash update for 3DS (with the amiibo support) which I think was promised for February.
That update is already out, was released almost a week ago. The main thing to notice is you only see the amiibo menu if you're playing on a New 3DS or New 3DS XL.
