If the hdd is being powered by USB that may be the reason why, while Nintendo stated that it will work with USB powered hard drives the did state for the best performance you should use a hard drive powered by a ac adapter

if you just purchased it then you should be able to return it, most places do give you some time in which a purchase can be returned most of the time its 14 days, but most places extends that during the holiday season. as a customer you have the right not to be stuck with something that dont meet your expectations for what yoyu bought it for.. the only thing you need is the reciept
I find it amusing the amount of users on NL that are scared to return their dodgy products because they hope that one morning they might wake up and all their hardware issues will just magically be solved by not doing anything about it... If that's the case then you lot must live in a big pile of unusable faulty crap
