Makes me wonder why Nintendo can't do the same with the Smash Bros. amiibos.
My best guess is that some people would buy the amiibo, scan to receive in-game contents with the read-only data, then still in box return it for a full refund. They can also do it in-store but there is less 3ds games that uses amiibo and the read-only data.

Yep Shovel Knight can be used in the box as there is no foil sticker under the Amiibo.
As for why Nintendo couldn't do it. They can but would need to stop putting the sicker under the Amiibo. But this would mean that people could walk into a shop and use the Amiibo to unlock or even upload strange names etc.
