Yes, you can illegally download ROMs, but you can also download homebrew or even dump ROMs yourself.
The only thing Ninty could do sue-wise would be the use of NES in the name.

Technically it's not illegal.

@BensonUii Yeah, people do use it to pirate games (Hence the generalization), but there's other uses.
Custom themes is one of them.
Also Smash 4 mods. Custom textures and music are always nice.
There's also emulators but people usually illegally download ROMs.
Also these hackers aren't malicious.
At worst they're selfish.
