@unrandomsam: So there are points in the game where SP are pretty much mandatory thus forcing you to either not use your 3DS at all for a few days or pay for the SP drinks, just like I suspected there would be? Is that right?
@sketchturner: Actually it is 127 lives (they used a signed int for some reason) and then after that your lives become negative. I also believe that was fixed in the All Stars version.
@Morpheel Yes and they most likely had to write it all by hand as there is no way Nintendo's SDK can handle making a region free game. Not to mention that it is an eshop game, it is most likely physically impossible to make a cart that is region free even for Nintendo. Also, most likely with those games the region checking code is in at least a dozen or more places within the game at random locations in the code (not just at boot) thus it would be nearly impossible for an existing game to be made region free even as an eshop game. It would take quite a while for the game company to make sure they got all the region checking code especially if some region checks only happen say, one playthrough out of ten.
XSEED can't drop the region lock as on the 3DS region locking is mandatory and it is only possible for a game to be one region only. To make it work they would literally have to put both the US and EU game chips in one cart and have a physical switch to select the region which would be quite expensive even if Nintendo would allow it.
It will most likely not come to NA, just Japan, the Europe, and Australia. I mean they can't even bring Super Mario 3 to the 3DS/Wii U virtual console in the US so what makes you think it will happen with this game?
I wonder if Nintendo has any plans to fix it by adding additional servers or if they are just planning on waiting until things die down on their own. They might not want to "waste" the money in upgrading their network just so that they can handle the holiday season better.

So unless you are the kind of gamer who always play Devil May Cry on "Hell or Hell" mode or even I Wanna Be The Guy on Impossible mode then you will have the choice of either not being able to play it very much so you can build up enough SP or buying SP drinks.

Apparently this update is designed to fix issues with your NNID randomly deleting itself in certain rare situations. I suggest getting it immediately.
