Popular Video Game Music YouTube Channel Receives 1,300 Copyright Claims From Nintendo

The easy availability of videogame music is a way for people to enjoy, remember, reminisce and create a community around their favourite games, even during times when we're not actively playing them.

Nintendo clearly doesn't see it this way. :/

Nintendo, just put your gosh darn soundtracks on streaming services if you're that precious about them!

Nintendo should finally start putting their music on YT or Spotify and everybody would be fine.

Okay I feel I havr to butt in. YouTube has a way of letting you upload videos but let the original owners of the content "stake their claim" so to speak. I made a remix for an artist once and uploaded it on my channel and the artist sent a copyright claim type thing to me, so any proceeds go to them.

I am almost 100% sure Nintendo would do the same but be blocked by the owner of the channel.

So I don't believe this is Nintendo being petty, but rather the channel making money off of their content.

YouTube really needs to fix its copyright system. But they keep caving in to corporate demands. The same thing happened to a YouTuber who made reviews about anime, Toei Animation got all his videos taken off the platform. YouTube is screwing over it's own users as usual.

Once again, Nintendo discovered the internet a few years ago. We can expect to find their music on streaming service very soon, probably before the end of the century.

I suppose it is specifically stated in Nintendo’s content guidelines to not publish soundtrack videos, but even so… we just want to listen to the fantastic music from Nintendo’s games! I guess we can’t have a legitimate/“Nintendo certified” way of doing this without just playing the games themselves…

Why does Nintendo copyright claim music on yt but doesn’t offer any way for us to listen to it outside of games and some promotional cds. It’s not like having these songs online is harming them in any way.

No one in sane conscience believes their Youtube.channel with Nintendo based content will last much.

Please Nintendo, just make a account on Spotify. I have downloaded many soundtracks from Nintendo because they arren’t available anywhere.

I'm torn on this. On the one hand it's dumb from a PR perspective because they're not exactly selling this music anyway and it's basically free marketing and goodwill from fans to leave it alone. On the other hand, due to the way copyright law sometimes works, failure to defend a copyright claim can harm your chances of defending a more legitimate breach in court in the future. They need a better strategy than their current one.

Nintendo is a great company and I love my many many consoles made by them - (12 plus) and over a thousand games….

However they also do a lot wrong….

@NoxAeturnus I'd question how much marketing/goodwill it is though. Like I listed to the tracks on Silvagunner.

But Nintendo started cracking down on this stuff towards the end of last gen. But this gen they're doing better than WiiU/3DS combined.

I'd question whether there's a break away between Nintendo and their online fan communities. Where all this crap like uploaded music, romhacks, etc. actually have no real benefit to Nintendo and in fact the reverse. Its only of benefit to the content creators precisely because of Nintendo's IP.

Cause it always seems like Nintendo's own fanbase spearhead biggest hate campaigns against Nintendo's games (Tomodachi Life, Paper Mario, Smash Bros) and systems over perceived slights.

1300 claims? That has to be some sort of record nothing comes to mind which are even close.

nintendo has strict policies, this didnt come out of nowhere and could be fully expected. its one thing to download roms/music etc for personal use, but its an entirely different thing to post stuff on the internet for personal gain

I am split in the middle as Nintendo needs to do this if they want to keep their rights to the Copyright.

BUT the problem is that Nintendo doesn't offer a way for people to easily access these songs/music. Same goes for their old games that they own the IP's too.

So if people want to access these by other means then I feel that they should be allowed too as Nintendo themself aren't going to bother too.

@Faruko It is stated in the artical that they doesn't monetize the videos with the songs. If there were ads on the videos then it wouldn't have been them that would be receiving the money but youtube and the IP holder of said song would.

I'd question whether it's fair that people should access Nintendo's music as simply as putting <insert game> ost on youtube. Just because Nintendo aren't allowing instant access.

I learnt this myself recently - I posted a map clear of a gacha game recently, and a week later wanted to view it again, was greeted by ads... smh.

Nintendo should release it games soundtrack on Spotify or create a service that allow use to listen to her franchise soundtrack(missed oportunity not doing this)

Nintendo will launch a game music streaming service for switch. you will need to be in the room with the switch powered on and also have your smartphone hardwired to the switch USB port via a proprietary cable. audio will play from your smart device via an app, but not the Nintendo apps that already exists. Bluetooth transmission to headphones or speakers from the smart device will be disabled, however. Also please note the audio will stop playing if the screen of either device is turned off. The service will require an upgrade to the Nintendo online service from the current highest tier. At launch 10 first party Gameboy titles will have a presence on the service, but please understand further titles and possible consoles will be added at a later date.

@Giancarlothomaz yes and no! Ofc its a missed opportunity, but is there really anything to gain for nintendo at this point? nintendo has been creating artificial scarcity for a long time. They could produce more but know that fomo and extreme rarity work in their favor. They just value their stuff differently. From a consumer perspective its not too friendly, but there is one big pro, there is a lot of value in retro nintendo products.

@SuperZeldaFun gilvasunner rips the files from games himself. He’s been doing that as long as YT has existed as he’s one of the OG youtubers. People making him out as malicious don’t even know who he is it seems. It’s not like he just started doing these uploads as he has been doing it, non profit, for over 10 years before the first take down on his channel in 2020.

use content id so nintendo gets the money instead of taking it down or create a spotify account

@SuperZeldaFun I am not going to lie and say I not used that site or even abandonedware cause I have for many games (until they re-released the game again or add it to GOG for which I will buy them so that I own them legit) but I will only do this for games when there is no means for me to buy a game that will lead to the owners of said product to receive money.

Still how many ordinary people who aren't as tech savvy know about these sights and will try and look on more established sites like Youtube or Spotify to find the songs they are looking for.

Last time they got Supradarky, YEARS of play lists, community etc. Down the drain.

I can't tell you how many games I discovered because of game music, and that channel specifically! Undertale, Anondyne, and I think Ace attorney but that's so long ago I'm not sure!

I rest my case. It's not just music, but it can seem like music - whose unauthorized distribution arguably came to YouTube last among its many other outlets - is the most buzz-catalytic example in fandoms.

@Rosalinho That's how I feel about it too! There are some banger soundtracks for many old or new Nintendo games that I'd love to listen to outside of the said game. However, Nintendo hasn't caught up with the times and doesn't list their soundtracks on either Spotify or Amazon for purchase. It's frustrating to find alternative sources for said music, especially when I'd happily pay!

There are two sides to this argument.
On the one hand, it's not theirs to post it to YouTube, and it's entirely within reason for Ninty to take it down.
On the other hand, Ninty should probably give us access to this stuff, somehow.

Sooner or later, people are gonna start talking about OST preservation on the same magnitude as video games themselves. If there's one thing Nintendo really sucks at future-proofing any method of listening to video game music.

No one wants to bring their Nintendo Switch around with Super Smash Bros. Ultimate to listen to music, and other games don't have a reliable music section. I've tried it once and it's certainly not as convenient as using my phone.

Surprising they lasted this long, but I think this sucks. It's not pirating games. It's not easy to find their music elsewhere either...Well it is, but not legit.
I can just imagine Nintendo will now do something super expensive, no chance they'll do things VEVO style on Youtube, they are bound to enact some kind of stupid paywall that is asking more than what the biggest stars do.

Having Apple Music myself, I would love it if Nintendo put their soundtracks on the service. As it is, I'm seeing more and more anime music on the service, even for some more obscure ones.

Listening to Nintendo's music on YT made me want to buy the games more. Listening to the Skyward Sword soundtrack and Zelda music in general made me want to buy more Zelda games.

I understand why Nintendo does this, but when they don't green light their own equivalent, they miss out on grassroots, community-driven brand promotion.

For music fans, this is the equivalent of Nintendo banning all Pixiv/Twitter/Artstation artists from creating illustrations of their brand IP's. No more fan illustrations of Zelda, Pokemon, Final Fantasy, Splatoon, Animal Crossing, etc etc. The presence and appreciation of community-driven brand awareness helps promote the brand overall.

Not sure if Spotify is the answer since they are being burned to the ground right now, but Nintendo should absolutely put their music on streaming services.

I saw this Article and my mind immediately snapped to the Channel 31 Horas Music. They have a complete library of Smash Ultimate Music. EVERY. TRACK. It's only a matter of time before they get taken down.

Until Nintendo provides us with worthwhile alternatives, these decisions will be forever worthy of criticism. Why bother putting music in your games at all if you want nobody to listen to it.

It’s a bit complex. On the one hand I understand why people feel entitled to share content that the original owner doesn’t make available. I feel the same about rare old vinyl tracks that never saw a digital release because label, band and everyone are long gone.
On the other hand: Let’s not be naive. Even if this YouTuber doesn’t directly monetize the videos he still profits massively from the big numbers of views they pull in. He makes a name and builds a brand for himself, that’s why he does it. Attention, reach and subscribers are the digital currency.

No you see, they like their games, so whatever the faceless huge corporation does must be justifiable.

(Never mind that they don't bother to make their music more accessible. If you won't bother to make your library easily available yourself, don't complain when others do it for you. That is my stance on piracy as well, but that is another discussion.)

I'd have no problem with this if Nintendo had all their music up on their own Youtube channel. It's the same problem with them taking down ROMs of lesser known games. Nintendo does nothing with them, but they don't want the fans doing anything either, so I guess were just supposed to forget about them.

I feel like because GilvaSunner is such a big channel, they attract the most news, but that isn’t the only channel being taken down. Tenpers and Ezonater both compiled mixes of certain types of Nintendo music, and now they’ve both been forced to get rid of what little YouTube fame they’ve had and retire because of Nintendo being terrible. It would be much appreciated if Nintendo didn’t target creators who are compiling their music when Nintendo doesn’t out of a sheer love for the company.
EDIT: I also want to emphasize: these channels are NOT monetized, there are no ads, it’s out of a love for either Nintendo or compilations, I’m not sure which.

Nintendo is the only company dumb enough to not realize that this is free advertising for their games.

It’s not a Japanese thing. Fromsoft (Japanese company) actually works with streamers by giving them early access to their next big game and encouraging them to stream or upload vids to YouTube. Case in point: all the souls games past the first one, including Elden Ring. Capcom is another company that is well known for supporting its gaming community, by helping endorse fan-made games of their franchises.

Nintendo makes enough money off their properties. Taking down a channel that isn’t even monetizing their videos is just plain stupid. Whoever is running this company is a complete moron, and they certainly won’t get another cent from me.

Whenever people feel confused as to what Nintendo's path is - take heed towards Disney. Nintendo is making a play to become the Japanese Disney. That is it - that is what Nintendo wants in all things.

This is stupid. They should give a substitute for this if they feel the need to remove it. Why don't they publish their music themselves on Youtube.

To be honest, I don't care. I don't listen to video game music beyond playing the game. When I want good music, I either write my own on bass and guitar, or listen to Katatonia or something. Video game music is absolutely boring and annoying outside of playing the game imo. I own many CEs with a soundtrack included, and haven't ever even given it a thought to listen to them.

These YouTube channels are an amazing service since Nintendo fails to put out their soundtracks anywhere online officially. Here's to riding the high seas!

God Nintendo are dumb. I’d buy their OSTs in a heartbeat on vinyl if they made them available. They don’t. They provide no feasible way to access their soundtracks therefore these channels have every right to put them up. It’s free advertising.

I'm upset at Copyright laws but I don't want to try and change them so I'm going to verbally assail a company who is enforcing the copyrights on their own products. I also am going to be upset at said company because they won't do a thing I want them to do and completely disregard them and their reasons because my personal reason(s) why they should is/are more important.

If Nintendo's going to take down these channels, they need to make some sort of replacement. I would happily pay for a digital collection of game OSTs.

I find it fascinating that most of the battles Nintendo fights against the internet are fights instigated by their lack of care for their own properties and respective fan bases.

Why create games in franchises where fans asked for a sequel for decades when you can just fight legal battles against fangames?
Why offer legal and affordable ways of buying / listening to some of the media defining soundtracks when you can just strike down free PR?
Why would you offer your own, easily available and easily distributable back catalog when you can instead use that energy to ban alternative ways for people to enjoy your creations decades after their availability?

I mean, let's not be silly here, Nintendo just sits on stuff that quite literally shaped the industry they are now part of.
Why should they do something with that?
And more importantly, why should they let people preserve and cherish it?

All jokes aside though, the biggest Nintendo paradox for me is how reluctant they are to preserve their own creation all the while they come up with bizarre design decision like "No more new characters for Mario games, only Super Mario Bros stuff" as if they need to cling to past effords.

Yes keeping pulling down my favorite music, you know a lot of the games I buy are based of the soundtrack, some of them I would never play if it wasn't for that, so I would love just to listen to the music everyone and again, because its not like you have a way for me to listen to it, but no, take down channel after channel.

If you want to have it changed, then do what other people do. Vote for people that want to change them. Or go protest against copyright.

In the end companies like Nintendo make games because they want to sell these games to the people that want to play them. If you take away the game selling, Nintendo would go bankrupt. Which would stop the games from being released.

I love games, so I pay for them.

Also this uploading of OSTs is in no way transformative, and all those OST YT videos are monetized. So.. "fair use" will not count here either.

@Einherjar Even more bizarre are the people who treat people such as Gilvasunner as criminals or demons. It's like they're incapable of parsing that these people provide a service that Nintendo themselves by and large are unwilling to shell out for, or do.

I have several MP3s of Astral Chain tracks and a couple from Daemon x Machina on my personal playlist. Also several remixes and remasters of official game music. Because I enjoy them.

Is music that hard to find for games? I don't have problems getting CDs imported. Unless people don't want to even pay...which I have seen people make that argument.

SilverGunner, in this case, didn't monetize their videos.
It would be a whole other story if they did though.

Of course Nintendo was gonna do something. They would be shooting themselves in the foot if they failed to defend their IP on a regular basis. This wasn’t the first channel that got hit for Nintendo music uploads.

Even the uploader himself knew he was in the wrong, but still did it anyway hoping to avoid this scenario so no idea why there is debate here. Just because he didn’t monetize doesn’t mean Nintendo is now legally obligated to allow his channel to still grow off the back of purely Nintendo music

@Marioman2020 That’s weird… 31 Horas Music was hit with a bunch of copyright strikes and takedowns before GiIvaSunner was hit, back in November of last year. I remember because people were offering an alternate way to access the entire archive of Super Smash Bros. music to preserve everything lost.

@Marioman2020 They already tried, but he's working to reupload anything that was taken down and everything that wasn't has been unprivated after experimenting with giving the uploads names and thumbnails that were meant to go under Nintendo's radar

@Einherjar Most of the channels who post Nintendo music and other VG music typically don't monetize their videos. Usually acting as a sort of internet archive people can readily access so long as the videos are available.

Which is why I find the people who revile them so bizarre.

As with video games, I personally still purchase the physical media form for music I enjoy including many complete soundtracks listed in GilvaSunner's list. However, I prefer listening to my music digitally, so I rip my CDs and place the tracks on a cloud storage where they're accessible by all my devices. While I sometimes need to research various music selling outlets beyond Amazon for the best deals, the result is ad free music (downloaded or steamed) that only I can take down.

I don’t get how people can upload the content in the first place, since YouTube ask you to confirm that you own the copyright or have permission to post the content you are submitting. The person clearly doesn’t own nintendos soundtracks, so why would they bother in the first place?

I post remixes on YouTube, hardly original but at least I could claim I have created some content. If Nintendo were to target remix channels I would probably argue more in favour of the content creator

@EarthboundBenjy It's even more than that--video game music stands on its own as a work of art, irrespective of the entertainment medium it was composed to coincide with. I don't listen to Tropical Freeze's soundtrack to reminisce about the game (though it is excellent); I listen to it because the melodies are moving and strike a deep emotional chord in me. That's why Undertale music lives in my head rent-free, even if I think the game is overrated as heck. Toby Fox is still a masterful musician. I can feel instrumental music in a way that pop or other contemporary genres seldom manage to achieve. Video games and movies are basically the only thing keeping classical forms of music alive, and that significance can't be understated. David Wise, Yoko Shimomura, Koji Kondo--it sounds a little silly, but these are the Mozarts and the Beethovens of our time.

There are a few things that make me think I shouldn't visit NL anymore. Misinforming people about copyright law in order to anger them and profit from it is one of the bigger reasons.

Nintendo are like wolverine, they get their claws into everything they see just because of the justification of who they are, that's the only reason they do it, with an age of social media, and trying to show or emphasize how much you appreciate the old days and older games, Nintendo makes that situation very hard and it difficult to deal with Nintendo in this age because of it!

@PixelPerfect I still have my skyward sword soundtrack disc I got when I brought the limited edition wiimote plus, I ripped that disc to my phone and listen to it occasionally and it still brings me joy in its moments, you can't do that in today's rules and laws because of YouTube taking that all away, no wonder why audiophiles peeps like LPs and older music because it's more easier to express how much love you have for older music 😁😁👍👍

If sharing a small part of their content is what they're against...

...why not go after gameplay videos and walkthroughs? Screenshots, Wiki pages? Maybe even Let's Plays, no matter the monetization? While I don't want any of these taken down, I wish game companies were a bit more consistent and predicable.

It's to drive traffic to his channel so he can make money of all the other videos. It happens all the time on Youtube and most people just whinge about big business screwing over the little guy when it's the little guy leeching off the big business. Without the big business there is no content, it's that simple.

Why does anyone listen to this music on YouTube anyway? Every Nintendo soundtrack can easily be found for download. Just do an ounce of work, download them yourself and enjoy it however you want at a better quality with no risk of them ever being yanked. Heck, you can run a streaming music server from a raspberry pi if you absolutely need it that way.

@EarthboundBenjy I know someone who is a huge Nintendo fan, but 95% of what he has in music from Nintendo games comes from places like youtube/less legal sources.

He would gladly pay for a (preferably) a CD soundtrack, but they are so hard to come by, and if you finally find them it's import + pricey import fees for us EU buyers (he gets them, I would do the same because I like having it physically).

But even when going digital, near impossible.

Nintendo needs to set up a playlist for their soundtracks on their channel! People don't want to pay a thing for something that is free, such as YouTube.

@somebread You're actually correct, I didn't research the Youtuber because I don't care too much about it. The guy SnesDrunk had the same thing happen to him a week or 2 ago and he definitely drives traffic to his channel via video game sound tracks. I just assumed this was another uploader like SnesDrunk. And life isn't so black and white, I like SnesDrunk even though I don't like uploaders profiting off other people's work like he did for years. Nobody is perfect.

To be fair, I only purchased a handful of game soundtracks, Killer Cuts which came with Killer Instinct, Senran Kagura with came with the game for 3DS, Super Mario 64, Mario Kart 64, Majora's Mask, Mortal Kombat, and Final Fantasy I & II. The rest I enjoy streaming such as Donkey Kong Country.

it is no way driving sales for him, as he doesn't make the remixes he posts, and it isn't driving sales in any way different than someone clicking on the Mario World OST, going "wow, I want to see where this came from", and buying it

@somebread Nintendo payed $580 million to build the theme park in Japan. People pay to go to a Nintendo theme park with only one ride. The rest of the experience is walking around looking at pictures, guys in Nintendo suits, going to the super mario cafe. Nintendo invested so much money in it and it's just the brand: The characters, the music, the art style. That's it, no video games. It is worth insane amounts of money and they have every right to protect themselves.

The original super mario bros theme must be worth an incredible amount of money to them.

It is Nintendo’s music and they do sell OSTs (and even if they didn’t, no one has the right to steal their music). I don’t see the issue here. Other than the channel owner trying to froth up some misguided outrage on Twitter.

If Nintendo had put some indie band’s music on their YT non monetized then folks would be calling to boycott the company.

The amount of money the victim has does not make it ok to wrong them.

We should all send Nintendo cease and desist letters. All that money they are wasting legislating the internet should be going towards their next game, their next console, or their next big movie venture.

@somebread Nintendo still made the sound tracks, them not selling them is no reason to allow anyone to steal it. Also Nintendo does sell soundtracks to many of their games / IPs (in Japan at least)

@sanderev which is fair and good in some cases (albeit i still find it questionable when there is no money being made off of it), but as you can see from that 2020 list, there are numerous games that don't have a soundtrack release period (see: luigi's mansion)--it feels like "steal" is a misnomer when there is nothing that can be stolen

@somebread For example: GameFreak used to release the OST of their games onto iTunes. But the stopped doing that after the Let's Go games. (Sword & Shield isn't on iTunes) Does this give me the right to just download (or stream) the soundtrack? No. Because they still own every single right to that music.

And sure piracy isn't stealing in the traditional sense. But it's illegal none the less.

Also people keep uploading these pirated music / games / etc. thinking Nintendo would act differently.

It's a loop:
1. Cry about Nintendo not releasing something.
2. "Release" it yourself (music, fan game, old game roms, etc).
3. (optional) Have fun with 5 minutes of media fame.
4. Nintendo takes it down.
5. Cry about Nintendo taking down the pirated work.
6. Go to 1.

Time to sail the high seas for Nintendo soundtracks.

Nintendo are entitled to take the music down. Sure it is a shame that they do, but that is how it is. There is a way you can listen to the music and that is to play the games. You are not entitled to listen to it any other way, and sure streaming services would be convenient but there isn't enough money in that for them to see it worth doing.

Sadly no, every time theres anything copyright related the defenders just type their "Nintendo was in the right!" or "its their ip!!" comments then pat themselves on the back.

It's really made obvious when articles like this on specifically state that the uploaders don't monetize their videos yet they say that they are anyway lol.

As for this copyright claim in particular, I don't care that much considering when Nintendo takes down a video uploading their OST five more will pop up. So my list of offline MP3s for Nintendo OSTs will keep growing

i've gotten games cause a random song from them started auto playing that got me curious before.

If Nintendo are so eager to do this, they should just sort out putting together a channel of their own, dedicated to OSTs.

I love that Nintendo doesn't roll over and allow entitled gamers to walk all over them and steal their intellectual property. I also love these big stories everytime Nintendo does this, like you all didn't know it was going to happen.

Stealing music is the same as stealing game assets and making a "fan" game. One could argue that it's free publicity but others, the law, could argue it's stealing and the free fan game could hurt the sales of a regular full priced release

Even if Nintendo decides to put their music on streaming services, expect an incomplete collection, low quality, and not having the unused tracks that are found thanks to rips.

Nintendo once again convincing me not to buy anything they stamp their name on. It would be different if this music could be bought digitally or streamed. As a company, Nintendo has done more to destroy video game history than anyone else, which is crazy to think about. All the ROMS that are now harder to get because they rampaged a few years ago and major ROM sites were shut down. Most of the lost ones weren't even Nintendo's games. In a growing time where I have so much to choose from, Nintendo continually pushes me to other platforms. I want to be a fan, but it gets harder every year when they do this crap.

Nintendo being pathetic as usual. No other way to listen to them, doesnt hurt them financially, actually helps them make money because people sometimes buy games based on soundtracks.
So this is yet another move JUST to be petty.

I believe these copyright claims are fake. When Nintendo sends a takedown request on YouTube, they list the division of Nintendo (Nintendo of America/Japan/Europe, etc.) But the claims list simply Nintendo. I got this from a Twitter post that I don't remember, but if someone does, please link the post.
