Popular TikTok user and Twitch streamer Pokeprincxss has been forced to rebrand and hand over money to Nintendo after being sued by the company.
Gaining a mighty 1.9 million followers on TikTok and more than 50,000 followers on Twitch, the star has been selling merchandise based around her branding and also trademarked her username. Her name and merchandise are both inspired by the Pokémon franchise, with items including imagery of things like Poké Balls.
The star has taken to YouTube to explain the reasoning behind her sudden channel name change, telling viewers that she'll now be known as digitalprincxss, dropping the 'Poke' from the name altogether. "I was young and dumb and I was just going full force with it because I didn't know what I was doing was wrong," she says (thanks, GameRant).
Pokeprincxss – now digitalprincxss – has received a cease and desist from Nintendo, and believes that it may have been issued thanks to the merchandise imagery, her trademark, and the fact that she also works in the adult entertainment industry, presuming that Nintendo might have wanted to distance itself to keep up with its family-friendly image.
Speaking on Twitter, she has since said, "Reminder to please be kind to Nintendo and not harass them. I am on Nintendo’s side and even though I showed emotion about the name change I still respect and understand why did had to. I love Nintendo and so should you."

It is uncomfortable for some to recognize the solution "do not take intellectual property that doesn't belong to you - just make your own original work" but it is sound advice.
I am sorry she has to find out this lesson the hard way, sincerely. It sucks to go through.
I am also sorry that the creation of original work does not instantly get you likes and follows (or money) like taking someone else's existing popular IP does. It would be awesome if life was easier, and people valued original content even more than they do. However here we are, so we put our heads down and get to work.

This is a weird one this time compared to Nintendo's other cease and desist cases but if you're factoring IPs to help promote your brand regardless of who's IP it is then she should've seen this coming.

Nintendo: The Disney of the video game industry. Remember when AVGN was called the Angry Nintendo Nerd? After he got really popular he got a C&D and had to change his whole branding. A lot of people have no idea that was his original name.
I think the reason Nintendo moved in here rather than let's say... AustinJohnPlays (who sometimes sells merch with original art inspired by Pokemon) is probably the porn connection. Pokemon is a family friendly brand and a YouTuber who also works in adult industry using "Poke" in the name and selling merch with Pokeballs sends the wrong image and makes it seem like Nintendo is promoting the connection. Still it's not a good idea to push your luck sometimes.

It had nothing to with her connection to the adult "entertainment" industry. Anyway, I don't have issues with people in the adult industry as I have friends working there in various positions (no pun intended), but some things like that Princess Peach game are a different beast. Was going to make a comment about whether or not I would get sued for my username, but I can understand why Nintendo would do it after reading the article (even if a lawsuit is probably on the extreme end, but I'm...not looking further into this).
Almost hard to believe a woman in her twenties or thirties didn't realize selling products inspired by the copyrighted Pokémon IP (a brand one could argue is generally geared towards children), using an internet handle based directly on that copyrighted IP while cultivating a large following on a controversial social media service and using the platform she built on the back of that copyrighted IP to produce and market full-on pornography for a for-profit, highly visible porn side business was not a wise decision until she received a cease and desist.
Maybe with her new handle, she can make the switch to Digimon: Digital Monsters, start selling Agumon buttplugs. Just don't forget to "respect the hustle" by using the proper sex worker terminology, lest you be slapped with a meaningless abbreviated 2010s woke Twitter label, or, God forbid, a grown adult's feelings be hurt. Nintendo typically looks the other way as long as you don’t copy and paste their trademarked images and stuff, but they do have the right to protect their brands if they want to.

Receiving a Cease & Desist is not the same thing as "getting sued." The former means sending a letter, nothing more. The latter means getting the courts involved. She was not sued. False headline.
To be fair, I think the name would have been fine if she'd actually challenged Nintendo's claim, as I don't think Nintendo owns the copyright to the word "Poke" in and of itself (as far as I know at least), and it certainly doesn't own the copyright to the world "Princess" for sure, nor the combination of the two (again, as far as I'm aware), but the use of Nintendo's actual copyrighted character designs and Pokemon art and the like is where Nintendo had a case as far as I can see. But, yeah, I think she should have actually fought back on the name part, and, having went through a 2-year long legal battle with Warner Bros. myself for my own company name, iNCEPTIONAL (because they claimed I was ripping off the INCEPTION brand), and won, I believe she could have too (on the name part alone). But, as per usual, everyone is afraid to challenge the threatening mega corporation.

For me, I couldn't care less if she works in porn or not. But that shirt above (example of her merchandise) IS a Mew. Its not "inspired by" Mew...that IS a Mew. And on the front isn't an "inspired by" Pokeball...it IS a pokeball. That looks like a direct use of the Pokemon IP brand and images, and I'm sure she didn't go to Nintendo and get permission to use it. A name is one thing, but completely ripping off someone else's images and using them to make a profit for yourself? Yeah, Nintendo did the right thing here. I'm sure the porn thing played a part in it as well, but when she moved to selling merch that directly stole images from Nintendo (or the Pokemon Co. if you prefer) to me crossed a line.

Merch is Pokemon's main revenue, and she's selling what appears to be direct copyright infringing merch, that's made worse by being tied to an "adult industry" worker, but really, the merch in general would have been slapped down regardless. @impurekind oh the name would have been perfectly fine. Nintendo does not own a trademark on the work Poke. I mean Pokimane gets by just fine without a call from Nintendo. And considering the name Pokimane is pronounced P-Oe-Kee-Mane the same way you pronounce P-Oe-Kee-mon. It is clear what she was doing when she picked the name which was a subtle nod to Pokemon.
This however crossed a line into a realm Nintendo needed to act to protect their IP.

@Travisemo007 Don't take this as fact, I'm just a teen so I've got a lot to learn, and my brain won't even be finished developing for like another nine years, but I believe the reason Pokemon and Poke restaurants can exist with each other is due to two reasons being that one, they are in different markets, and two, imagery and things associated with the respective companies do not overlap. Although the TikTok star technically was in different markets, being a pornstar/influencer, she was selling merch that directly imitated designs associated with pokemon, giving enough validity to her name being an infringement. Honestly, either side you swing to on this, I think everyone can agree Nintendo has more evidence on their side in this situation than Monster energy has had in their lawsuits combined.

A cease and desist is not the same as being sued. They’re pretty much opposite ends of the spectrum. You’re not even obliged to do anything if you receive a cease and desist it’s just a warning that if you don’t you’ll eventually be sued. If all she’s received is a cease and desist why is the article being so sensationalist talking about Nintendo sueing people?
Anyway it’s likely nothing to do with the adult industry connections and more that she’s mass producing merch using their copyrighted IP. That pretty illegal thing to do. I’ve had artist friends not at all connected to the adult industry nor with giant twitch followings that have received cease and desist orders from Nintendo for mass producing merch based on Pokemon.
And Nintendo has to do it, because if they don’t they’ve set precedent of allowing it. At that point the moment they try and stop someone abusing their IP in a court of law, their case crumbles as they knowingly let others do it. Slapping a standard bit of Pokemon key art (not even redrawing it in your own style) and adding your screenname then printing t -shirts doesn’t fall into fair usage. Nintendo had to say something.

That's actually kind of already happening and it's awesome! I don't think the big 3 are going anywhere, but self-publishing has become very easy over the last 10 years or so, which led to the deluge of high quality indie games we have today. I own a Switch, but Fire Emblem and BOTW are the only two nintendo games I own. I bought it because indie games publish there, and it's the only place to play most of them portable. I'm just waiting for a gaming-centric handheld pc, so all the great indies I own on that platform can be portable and I can say goodbye to nintendo's crap hardware.

@DrDaisy There is nothing artistic about selling shirts with other people's branding. Sure, some unique graphic design went in but come on. There are certain things I think Nintendo is way too strict about but this is not one of them

The other article I read didn't show any of the merch, so it just looked like they were suing her for using the word poke in her name... Her she is using pokeballs and pictures of new on hoodies, how did she not know it would come to that. She'd only have been able to do that it Nintendo actually allowed her to be a partner that would stream their content, but they aren't trying to do anything like that ever apparently.
When it all comes down to it those where Nintendo IP regardless of what shills want to say or think. That is a Name Brand and getting sold by someone else whom gives no Royalties to Nintendo is asking for trouble. That's the FACT and a cease and decease as another said is a Warning that further actions will not be so light.

She's probably too young to remember James Rolfe changing over from "The Angry Nintendo Nerd" to "The Angry Video Game Nerd" so that he could turn the character into a profitable business. Always best to carefully consider branding and if it infringes upon anyone else's trademark.
