It was not rated again. That sort of thing would make news. And you really don't understand copyright law if you don't see the difference between 1995 and 2009 (not that that's a bad thing... I wish I could erase this from my mind). By the year, these laws have become stricter and more ridiculous. Not to mention Starmen.net have spoken with sources inside Nintendo of America and confirmed that the ESRB thing was a mistake. Yes, it's within the realm of possibility, barely, but it ain't confirmed. Plus, if you really mean "any kind" of confirmation (which by your definition, isn't really confirmation at all but some sort of hunch), Star Fox and Yoshi's Island ought to be on there. Iwata said all first-party titles would be on VC eventually when the VC was first announced. Of course, he promised Earthbound among those, but apparently he did not consult lawyers before making that promise. Believe me, I want to see it on there more than anyone. I dread the day my SNES stops working, or worse, the cartridge itself.
Then why is it nearly impossible to get any Rare games on the Virtual Console? Because they have licensing issues. Basically, Iwata lied to us. I'm not saying he's a bad president, I'm saying he over-exaggerated his promise towards us.
Also, due to the Super FX issues, Star Fox and maybe Super Mario World 2: Yoshi's Island are questionable, despite Iwata's promise. Earthbound is more likely.
The supposed emulation troubles of the FX chip are a rumor Nintendo has never commented on. The legal issues surrounding Earthbound are confirmed fact by Nintendo of America by sources that haven't steered Earthbound fans wrong in over a decade now.
Also, I never said Rare games would be on the VC, so I have no idea why you bring that up. They quite obviously won't be on the system. I was only talking about Nintendo's titles. Nintendo does not own the rights to Rare's games.
Yea, Cheetahman, I'd like to think if the GBA can run Yoshi's Island, and if the DS can run emulators, that the Wii can handle these two games, especially a primitive specimen like Star Fox, but people keep tossing around these baseless rumors that the Wii can't handle The All-Powerful SFX and SFX2 chips. And yet other games with enhancement chips have been released without a hitch in some regions: Super Mario RPG, Pilotwings, Super Mario Kart, to name a few.

It's a shame that none of these SNES games are available for download.

And can you go a little faster?!
