I didn't think this was legal either but I'm not in the know with dev kits.

Circle pads- I like them. I think they have a sleek look but when the action knocks up it's a pain. I'm always reminded of the mini boss in Ocarina of Time 3D's Jabu Jabu's belly. Round and round my thumb slipping...not fun.

The sticker on the kit says you must return it to Nintendo so I'm guessing not legal.

I'm surprised that they haven't inquired about it. The sticker says it had to be returned by November 2011, so Nintendo probably forgot about it. How can they not keep track of this kind of thing?

There are several hardware revisions of the devkit so this is probably an older one. the Nov 2011 date seems to suggest that.

Circle pads are much more delicate and have limited use. Normal analog sticks work better for home consoles.

It's fake, and yes it violates dev agreement. The resale prohibited label. All models of the dev kits have been in the backgrounds of E3 presentations which is pretty funny to us devs.
