So no, they are no more first party than Monster Hunter Tri or Dragon Quest IX or Samurai Warriors 3 - three more third party games Nintendo published.

Microsoft doesn't own Last Odsessy as far as I'm aware. Mistwalker merely signed an exclusivity agreement.
And regardless, even if Microsoft/ Nintendo acquired these IP, the developer is still Mistwalker, who is very much a third party.
Actually, technically Fortune Street is third party, so I'm changing my Wii-game vote to that.
Intellectual Property refers to the company who own the rights to a branding. The game itself can have been developed by another company, but the brand is still owned by the company that holds the IP. For example, Zelda is Nintendo's intellectual property, but several of the Game Boy/GBA Zelda were developed by Capcom. Same with the upcoming Smash Bros, by the sounds of it - it's been joint-developed by Namco Bandai. Namco Bandai don't hold the IP for Smash Bros, Nintendo (more specifically afaik, HAL Labs) does
