So... how can we tell what's DRAWN or what's inserted to look like a drawing via a photo on the dsi itself? I noticed you can add a photo from your dsi and it will show up like a drawing. How can we tell the difference?

not sure if all of these will show, but try these.
I'm with Ballistikboy that some animations are using the camera or other capabilities--not that I have a problem with that (I have some ideas I'm looking forward to trying out with the camera), but they shouldn't pass themselves off as hand-drawn.
The one above is definitely not hand-drawn. I'm not sure how they achieved it, but clearly a computer initially rendered all those lines in order to get the smooth polygon motion, there's no mistaking it. They might have simply printed out each frame from the computer and used the camera to take a picture of each one, or used a similar method, but they certainly didn't draw it by hand.

Well, to tell you the truth, it's hard to dispute the fact that some FN animators use the features to the highest advantage in ways we can't really understand (yet) but differentiating between camera flipnotes and hand-drawn may be from its look and style. Imported photos will have to be manipulated in order to balance the black and white and hand-drawn flipnotes range from fairly easy to spot to "OMG! No freaking way he drew that!"
Differentiating is more of a personal opinion, unless the animator came clean on how he/she did the flipnote.
i don't get how you draw really good ones with the shading like wih the wind blowing cuz you'd have to keep re drawing it a lot. Anyways here is my super amazing one [flipnote:54FD6C20CC783520:783520_09087B67625EA_003]
