Is the judge insane? if i where Nintendo i file a lawsuit to the judge for supporting piratething, besides that this has noting to do with Nintendo Controlling it softwares in fact Nintendo hasn't controlled it's software in years (seal of Quality gone for just a seal) this is about copyright and third party companies ip, franchise whatever software protection, what's even worse is the judge forgot that R4 Manufactures didn't pay for games or other forms of media meaning the warehouse along with the manufactures needs to be shutdown and paid for damages towards illegal emulated software, it's obvious this judge should be fired and never practice law again and paid for damages towards Video Game Industry and another thing i don't get he mentioned that Nintendo doesn't have the right towards software controlled towards it's hardware WTF? that's how the Video Game crash happen.
Remember folks, laws in Spain are different than the laws here in the US, and with respect to IP rights tend to be more liberal. Under Spanish law and given the nature of the action brought, the Judge appears correct in his ruling. And note that the judge did not so much as rule against Nintendo on the merits of their argument, but rather dismissed the action, as it was brought under provisions of Spain's penal code which the Judge essentailly felt were not applicable.

You said it better than I would have. Laws vary from country to country and it's insane to approach the case as an outsider without realizing that.

I doubt he had language problems. Although that statement about things that can do illegal activity, and how they should be banned, casts suspision that your thought process is malfunctioning.
What can't be used in illegal activity? Also objects don't commit crimes people do, I dunno if banning humanity would work very well, as it'd be humans doing so.
What's funny is that Nintendo thinks it can stop piracy. I mean, yeah, they have to look like they're doing something, but still. They aren't going to win, least-of-all in the US where we have free-use laws. Besides, they make plenty of money anyway, with the amount of pirates around. It ain't THAT big of a deal.
