Topic: Question regarding "not for resale" pre-owned game copy?

Hi there,

I started collecting Switch games a few months ago so i use to buy, sell & trade some of my copies in order to afford other things. Long story short, I recently bought a copy of octopath traveler which according to the seller, came "bundled" with the Collector Edition BOX but i didn't realize that it was an alternative artwork copy (not retail) and says: "not for resale" in the box. My question is: Am i free to buy, sell or trade "not for resale" games as long as they are "pre owned"?.

I don't own the game anymore but I remember reading that "not for resale" means that the store can't sell the bundled copy by it's own but i'm not quite sure.

@Joakingdom I think the "not for resale" label was probably only relevant to the production process (like a reminder that it's for the special bundle you mentioned) & for retailers. I don't think it had any meaning for consumers. You could use it and sell it like game you've had.

You’re both correct. “Not For Resale” markings are for retailers and to denote that the product is part of a bundled SKU. A shady retailer would separate the items, and charge full msrp as if they were two individual products. It’s also so that retailers doing inventory could easier differentiate what should and shouldn’t be in a SKU count.

It has no legal bearing on the second hand market. This is from professional personal experience in retail.

As long as you bought it you can resale it to anyone else but you have to label it clearly so the buyer knows as part of the disclaimer when selling. Otherwise once you buy you can do whatever you want with it but if you only sell part of the complete set then you have to deduct the price of it when selling it.
