@Wexter exactly, they literally made an "advisory" notice to sever any form of liability that might be attributed to bricking/hacking of legacy consoles. This is Nintendo, ensuring they can't be sued, if the private network project causes damage to the hardware. Nothing to do with piracy, or any form of interest in the project at all. Otherwise, the recently "sue happy" Nintendo would already be drawing up paperwork on litigation for this.
creating a way to network purchased equipment, to play purchased games, because Nintendo abandoned it, is anything but illegal, and would never hold water in any form of litigation.
