Thoroughly unsurprising that Nintendo went after this; it's an unlicensed remake on a non-Nintendo platform. When has Nintendo ever let their IPs venture outside their own hardware platforms?
So under the circumstances I think waiting until after release with the C&D was the best they could do without compromising their own IP.
In any case, glad I got it. It's an excellent remake!
