I don't see the big deal about the optional Mercedes DLC. No-one is compelled to download it unless they wish to.
You statement is somewhat false. If you want to play online, you must download the update which contains the DLC.
But there's nothing that is forcing you to use the cart. It's entirely optional.

There are far worse industry trends that Nintendo can do to screw us over.
Day 1 DLC, on disk DLC, online codes, and the list goes on.
Nintendo has done nearly all them apart from online codes (But the prices are higher offsetting that).
Day One DLC - Mario Golf
On Disk DLC - Amiibo or anything for the DS that was unlocked via the wifi connection was always on the cart already. Don't know enough about how similar things on the Wii worked.
Initially my reaction to this was "meh". The GLA looked out of place. But after seeing the Silver Arrow and the 300SL in motion in the latest trailer, I can't wait to get these Mercede-Benz free of charge.
No, I don't thing having say Wario driving a Mercedes-Benz convertible in his "Wario's Billionaires" stadium will kill the magic at all.

I can't think of that ever happening, even when they've had a good reason Achoo! EA Achoo!. It's very bad business practise, and could cause Ubisoft Wii U game sales, that is if they bother to make any more Wii U games.

On the topic of DLC, I like to look at it from the following perspective:
1. Is the initial package (game) worth the price?
2. Is there enough content to warrant a full experience?
3. Is the DLC optional in most cases?
4. Does the DLC add value to the game, hence the extra cost (if it costs extra)?
I've played games like Fire Emblem and NSMB 2 that I can say without prejudice were full experiences worth their price. Despite the "Day 1 DLC", I wasn't really mad because the DLC was optional and extra, and it adds value to the games. Nintendo's done a great job so far from not turning DLC into a microtransaction hell.

It's NEVER a good idea to publicly criticize the company you work for.
