I do not know if Nintendo has fixed this or not but I read some other people's posts on the Nintendo Support forums and they said they were told that as long as it fits in the dock it's fine (it doesn't affect performance)

@Astra You probably should be putting your Switch in the dock. Thats what it is designed to do.
The Switch disperses heat via a mixture of a heatsink, thermal paste, a fan and a metal back just under the cover on the rear of the machine.
In the dock itself yes it would get hot as the system runs off mains and at full capacity. Air flows into the dock from the sides and back, into the recessed vents (recessed so even if covered, air still goes in) through the system, and out the exposed top.
Now for this to bend basically what will need to happen is the metal plate will need to bend, but that can only happen if pressure is applied, i.e. something weighting down one side so its heavier (like the battery) but as it stands the console doesnt actually touch either side of the dock. So the dock itself cant provide pressure to bend the system.
So what causes it? If it was the battery a bend would only occur if the system was lying flat where the weight of the battery would push either the front or the back of the system down, causing that bulge effect people report.
Bit that cant happen in the dock because its vertical so the Switch would logically bend so the left or right side is lower than the other side kind of like a droop.
The only logical answer is the heatsink that runs through the general middle of the system heats up and this, being connected to the metal plate via thermal paste, expands slightly and pushes the plate outwards a little.
But the cool think about metal is it bends back.
