Nintendo 14 day right to cancel DIGITAL CONTENT

Nintendo has refused to refund my sons shop purchase of the Witcher 3 even though the game was not downloaded (too big) and they refuse to honour there own 14 day refund policy. I know its a large download, my son bought it then instantly realised it would not fit without an SD card then tried to get a refund so he could buy the physical version instead

they say that when you click to purchase a game on the eShop then you cancel your rights to the "14 day right to cancel". how is that even possible

I always go physical for games i know are going to be massive in size. I only do digital for Indie games or other small downloads like retro stuff.

yes we do normally but son was eager to play The Witcher. looks like we learned the hard way

@ViktorEvil The 14 days refund policy in the link you provided is only a mandatory policy all digital stores have to offer by law.
As a matter of fact however all digital stores also force you (usually with a checkbox) to give up all your rights to avail to said policy, else you won't be allowed to purchase the game/digital content.

If your son purchased the game succesfully then he also (likely without noticing) accepted that he was giving up every right to ask a refund.

Some digital stores like Steam offer alternative refund policies in place of the mandatory one they force you out of, but Nintendo has nothing like that in place.

@ViktorEvil hey man Nintendo's the best. If Nintendo doesn't offer refunds then they must be right and we must be wrong. Please don't call Nintendo scummy but instead in 2020 vow to only say good things about the best company ever.

@sixrings love the games just not a big fan of the unfriendly policies especially in a machine largely aimed at a younger audience (I know Witcher is an 18 game but the policy still stands for a PEGI 3 game)

You know you can always contact your bank or CC and dispute through them and show them that 14 day cancel policy and if that is correct they will refund you the payment if they still refuse to honor it. Policy changes but when you bought it at the time of the policy that is the one that is in effect not a new one after the fact. That's like a contract where you renege on it and it doesn't work that way. So contact your CC/Bank and dispute it through them if it has to go that route and tell them that is what your going to do. So make sure you got all your facts straight and any screen shot of the policy 14 day cancel to prove otherwise as well when asked.

A debit card was used so I’m not sure if the same policy applies

True, and also that's just bad advice from SwitchForce. If you dispute the charge with your CC company/get a chargeback, Nintendo will almost certainly ban your account. This has happened to tons of people, so definitely do not try to dispute the charge if you ever want to buy anything else digitally.

Your best bet is to call them again and calmly explain the situation. Nintendo support is generally pretty understanding about that stuff, and they might be willing to fix the situation for you.

True, and also that's just bad advice from SwitchForce. If you dispute the charge with your CC company/get a chargeback, Nintendo will almost certainly ban your account. This has happened to tons of people, so definitely do not try to dispute the charge if you ever want to buy anything else digitally.

So what evidence do you have of this? Please provide this.

Because that’s classified as making a fraudulent purchase.
The bank is acting as the payee, on your authorized behalf. When you finalize a transaction, you are declaring to the bank that this is an authorized purchase, and the bank should fulfill its obligation to release your funds for the transaction. The product was provided as advertised. If a dispute is then created, you are telling the bank that either the product was not provided or the purchase was not authorized. It’s always in the terms of service for banking structures.
That’s not something that needs proof; it’s common sense. The bank has nothing to do with what happened. This is an issue between the consumer and the vendor.

Please stop giving terrible financial advice that could have undesirable affects on people.

@SwitchForce What @HobbitGamer said. Plus if you do a Google search of "nintendo" and "chargeback" you will get hit after hit after hit of people writing about how their accounts were banned. I actually thought this was common knowledge.

I have read limited instances of people getting a refund from Nintendo after calling them, but I wouldn't expect it. That's pretty rare, although still at least worth a shot. All you lose is some time on the phone, but Nintendo usually has courteous customer service, even if they can't help you. I would never dispute the charge or request a chargeback though.
