Donkey Kong Country was made by Rare, and those came out. Nintendo owns the IP. They have full rights to release it. Also, Viva Pinata made it to DS, which is made by Rare AND owned by Microsoft. It's more than possible, Nintendo just wants to pace the releases for whatever stupid reason.
