Fingers crossed for Donkey Kong 64, it could happen since Rare can work on portable titles for other companies. After all they did remake Diddy Kong Racing for DS.
Donkey Kong Country was made by Rare, and those came out. Nintendo owns the IP. They have full rights to release it. Also, Viva Pinata made it to DS, which is made by Rare AND owned by Microsoft. It's more than possible, Nintendo just wants to pace the releases for whatever stupid reason.
And Rare did say on their twitter a long time ago that they don't own the rights to DK64 and they don't know why its not on the Virtual Console
