Okay, so, UPDATE... (for those who might experience a similar situation)
I sent my 3DS in for repair. It was still under warranty. Nintendo repaired it and sent it back without any request for money. They seemed to have replaced the bottom panel where the controls are. I fully expected to pay for the repair since it was my fault but I sent it in regardless since I needed it repaired either way. Of course, I was happy and surprised to have not been charged and to have received my 3DS back so quickly.
Also, I did not lose any data during this process. All of my eShop downloads and save data are intact.

What! Nintendo did something right and stood by their consumers....there must be some mistake...you must be lying...Nintendo is awful and you should feel bad...head explodes
LOL...seriously though...awesome! Glad to hear a story about GOOD customer service in this day and age. Happy gaming!
