It could never apply in this situation for numerous reasons and cameos of people happen in games constantly. Two factors are extremely important in deciding it. 1. Hacking is literally altering any data at all. Is there a character that didn't return in the new game? If you mod the game to add them back in, that's a hack. Is your copy completely broken because of some random software issue? If you fix it, that's hacking.
You know the entire Skyrim modding page? That's all technically hacking. Some games are only popular because of this hackability. This is ignoring the fact that it's completely ridiculous to refer to friggin data miners and modders as "the scum of the Earth" when they're some of the most important cornerstones of the gaming community.
