Nintendo needs to be checking sites like ebay and amazon and what not cause ppl are already reselling their preorders at double or better...they need to cancel those users orders so we can actually buy them fairly

The best way to ruin a scalpers day is have a generous supply of the product so no one needs to pay extra to get the product. That is what Nintendo did with the launch of the Switch 2 and it ruined it for scalpers. If there is limited supply of this then scalpers may make a killing although personally I would never pay more than retail price myself even if I really wanted it. It is not something I would do. I hate paying full price for anything let alone paying extra over the normal retail price.

I have no idea why people pay scalper prices. While I suppose scalpers don't stop you getting the product (although they do for most people who don't have mounds of money sitting around), the option is bad.

Scalping should be a crime. During wartime, it is a crime. You are fooling yourself if you think that the same people who are controlling the flow of goods now in order to enrich themselves, won't enrich themselves further if given the opportunity, even if the goods they are focusing on are essentials. We started to see attempts at scalping cleaning products, wipes and disinfectants and such during the pandemic, and the authorities responded then.
Scalping could also be viewed as a form of racketeering, a verifiable crime. Racketeering is the creation of a problem, that either doesn't exist, or would not exist, if it were not for the activities of the person or persons creating it. For example, a common form of racketeering is a protection racket. The perpetrator visits a business and offers protection in return for a fee. If the business won't pay, it will be attacked until it does. Scalpers claim to solve an availability problem, by hoarding consumer goods in order to hike the fees and skim profits for themselves, from goods they had no hand in producing. While those goods may have still sold out, everyone who purchases from a scalper would have had the opportunity to purchase the goods from the original point of sale, at the original price, had the scalpers not already purchased all of the available products , frequently by using various automated systems, that are themselves profit motivated.
Racketeering is not part of a healthy free market. It is a crime.

Once again, I just "love" how much people want to enact ridiculously anti-consumer actions like "Eliminating the First Sale Doctrine", all because they are angry about not being able to buy something they want. Because, spoiler warning: that is exactly what you are calling for whenever you say "Scalping should be banned!"
