Re: Nintendo Files Lawsuit Against ROM Website Offering Nearly 300,000 Switch Downloads

Rubycabuncle

I've never heard of this website until this lawsuit.

But since this has happened. While we're all expecting Nintendo to win this since they seem unstoppable every time they go to court in regards to copyright infringement. At the same time. I'm expecting thousands of users to grab everything off that website and redistribute it across the internet in many future rom sites yet to be made.

I suppose we're all wondering how much will Nintendo be actually offered if this gets settled out of court like the last one.

Re: Poll: Have You Ever Had Problems With Nintendo Hardware?

Rubycabuncle

I remember my very first 3DS I got in 2011: The OG one. The product I had, had a damaged upper screen like when something heavy is pressed on it when I first took it out of the box and started it up that made it unreadable.

Lucky, it was under warranty and so I had it taken back the next day and got a new replacement that worked properly. My suspicions on what caused that would be aimed at the delivering companies or the EB Games store having the box placed under something heavy.

Haven't had issues like that with any 3ds models, I bought since. In another story: Shortly after I bought my Wii U 5 years ago. The Gamepad had this brown spot appear on the screen that can't be wiped away like a smudge.

So I researched and found out it was a dead pixel from the screen unable to generate that spot making it slightly defective and it could be replaced with a new screen. However it required that the back of the Gamepad be unscrewed to where the battery is, to open up the Gamepad. When I tried to do that. One of the screws became stripped and I wrecked the head of it after I tried using a screwdriver, then a power drill to unscrew it and it wouldn't budge.

My fault on that one. But it has left me somewhat upset that Nintendo never sold Gamepads separately (except in Japan, late in its life). But the spot hasn't affected my gaming on the Gamepad in any way, so it would be just a very minor issue at this point.

I remember the early years of the 360 era with the 360 arcade model suffering from the infamous "Red Ring of Death" that ruined gaming on it. All because Microsoft decided to cut corners to save spending on developing the hardware and they did it too much.

The Joycon issue would be seen as Nintendo repeating the same thing. This is a prime example of "Short Term Gains, Long Term Consequences."

People should be wary of this mindset. Cos it can affect Millions around the world.

Re: Conker's Creator Doesn't Think There Would Be As Much Noise For Other Rare IP On Switch

Rubycabuncle

I think people are treating Banjo-Kazooie being playable in Smash as a sign that the Rare from 90's and early 00's before Microsoft purchased them, is going to be resurrected to its full glory and bring Banjo-Threeie back to life and such as it was originally planned.

That is just mere fantasy. That version of Rare is dead and gone forever. The brains behind the old Banjo-Kazooie, Conker, Perfect Dark and Donkey Kong Country games have left the company a long time ago and don't seem to plan on ever coming back to it.

Re: Nintendo Music Copyright Takedowns Intensify As Another Prominent YouTuber Gets Hit

Rubycabuncle

There's a saying about the Internet. Once something has been put on it. It is there FOREVER.

These channels have had these music sitting there for YEARS, before they were taken down.

Therefore, it is very easy to assume that all the music they uploaded has been downloaded, reuploaded, archived and redistributed across the Internet in thousands to potentially millions of sites.

The Internet is clearly something that Copyright law, especially one that hasn't been improved other then extension of control since the 1970's, cannot handle properly.

The people that support this, get this through your head; There are 7 billion people in this World and the majority of them can access the Internet far easier now then in all previous Human history.

Not to mention that there are many areas in the World full of people that DON'T CARE about Copyright Law and will take what they can and upload it for free to the internet because they physically can.

Looking at it from an overall view. This is a losing battle for the copyright owners because this law is ultimately no match for the power of the Internet and they know this.

Another music channel will come in Brawl's place and take over its position.

Re: Sorry Nintendo, But The 3DS Really Is Dead Now

Rubycabuncle

I wonder if/when Backwards compatibility will be announced for 3ds games to future switch consoles.

Be a shame if classics like Super Mario 3D Land, Zelda A link between Worlds and the Gen 6 Pokemon games end up becoming non playable on future devices for years to come after the 3DS line has been put to rest.

Re: Feature: Inside The World Of Pokémon ROM Hacks

Rubycabuncle

Lets rip open some old wounds from 2 and a half years ago with the very C&D Nintendo sent to Koolboyman about Pokemon Prism. To remind everyone of Nintendo's stance and what they will do with unauthorize use of their IPs. Soak it in heavily. Straight from their lawyers' mouths.

"From Nintendo's perspective, there is no real difference in essence in terms of the infringement of intellectual property which occurs, notwithstanding that the intentions of the party engaged in "ROM hacking" may be driven not for financial gain. "

Now with what has happen to Pokemon Sword and Shield from GF controversial decisions plus this. Doesn't that make your Blood boil?? Because you feel powerless to stop it?

While people may preach Nintendo has every legal right. Doesn't mean that you have to defend every action they take.

These actions do have consequences and if people see this as classic Disney level Capitalism greediness. It could cause a surge in support for socialism to rise.

If Rom Hacking have survived this long despite all these legal attacks been thrown at it. Nintendo needs to have an epiphany to open a new door for opportunities for allowing the community mod their ips in a position where it wouldn't jeopardize their legal control over it.
