I think that will be down to the publisher. Warner had Batman as a day 1 release in North America, but we had to wait months here. If First of the North Star is anything to go by it's possible to have a day one release. I haven't seen any evidence that retail downloads follow the stated weekly release day like anything else.
I'm thinking that most big titles will be in the eShop day one. I know for sure Monster Hunter 3 Ultimate will be on the eShop, and Lego probably will be since Nintendo's publishing it.
I'm pretty sure Injustice it will be digital, but there's no real way to tell until ads or announcements come up.

In North America, titles are able to be downloaded at midnight of the day they are released. So literally the second that it is their release day. Which works out nicely, because if you're in the far west time zone you can download the game at 9:00pm
But it does come down to what the publisher decides. I know Nintendo is releasing Lego City at midnight.

Wow why didn't I think of that! I would of waited till midnight too haha sweet, my internets slow so I need all the time I can get while downloading games on the release date

Again this is all in the case of North America, I don't know about else where.
The time zones do not matter. Nintendo updates it's eshop at the same time throughout NA. Be it at whatever midday time on Thursday for regular updates, or for the midnight launches on specific days. The moment a game can be downloaded on the East coast, it can be downloaded on the West coast. Nintendo updates it at 12am EST. Which means depending on your zone, it can be either 12, 11, 10, or 9pm.
If you live in the EST zone, you can't just change your location to a PST area and download early
I know this from downloading various retail games on my 3DS that were scheduled to be available at midnight. And I was playing them before 9:30
I always thought it depended on West Coast time, because that's where Nintendo's located. It'd be harder and more confusing to separate it by Timezones, so I at least hope that's not how they do it. :/
I don't know. I'm thinking there's still some sort of location setting going on, even if you change the time zone manually. It really doesn't matter, because you're going to have to wait until midnight for the disc, and that's how it's supposed to be anyway.

I'll check again at 11p.m. and report back, but my bet is that it will show up at 12 a.m. like I originally thought.

If the 3ds is anything to go by then it will be there at noon est the same day. First party games so far are the only ones that get the midnight treatment! I've downloaded only first party games at midnight and the two 3rd party games I wanted were not there till noon the same day. In the case for monster hunter it was tweeted that it will also be 12pm eastern time of the 19th in NA! So first party is 12am and so far third party has been 12pm release day!
