What Nintendo SHOULD have done was have it for free for a limited time and then slap a price on it, but you know how much Nintendo hates making smart business decisions.

Actually you can
1. You use system transfer on DSi or 3DS and require money for it
2. Sell your DSi or 3DS with it on the systems account to jack up the price
Those are only 2 options

I think he's implying putting it onto an SD card and selling the SD card. I've seen it done with game saves as well.
Imagine if the winner just wanted the SD card instead
The DSi/3DS uses digital signatures for each unique system, so that wouldn't work until/if the signatures can be forged, and that would be illegal at that point.

Funny you should mention that. Nintendo said it was gonna be removed before it did and when it first came out Nintendo said it wouldn't be there forever. There were plenty of warnings

I belive that when it was first released they said it was only from September 2011 to February 2012. Not to be rude but if that wasnt enough warning I dont know what would be.
