Update: Twitch has said that it won't be streaming the E3 2021 Nintendo Direct today due to Nintendo's stance on co-streams:
Original Story [Tue 15th Jun, 2021 12:15 BST]: The E3 2021 Nintendo Direct takes place later today, and Nintendo has issued a statement which is unlikely to go down all that well with seasoned video content creators.
The statement was posted on Nintendo's official Japanese Twitter account, and says that while it's fine to stream your reaction to the broadcast as it happens, you cannot use any audio or video taken from the Direct itself in your livestream. So, if you're looking to run a live, as-it-happens reaction video as the event is taking place, you can only show your face.
However, once the Nintendo Direct has concluded, then reaction videos with the audio and video from the Direct are permitted.
The company has also released some additional guidelines for content related to the Direct, and states that if it feels that any of these rules have been broken, it will take legal action against the person who created the video. It's pretty standard stuff, to be honest.
These rules indicate that "videos and still images... include your own creativity and comments, except when using features such as the capture button on Nintendo Switch. Please refrain from postings that do not include your creativity or comments, or that are merely copies of Nintendo's game copyrighted material." Nintendo also states that users must not "suggest or misrepresent that you are sponsored or affiliated with Nintendo or any Nintendo official." Finally, Nintendo confirms that monetisation of reaction videos is permitted.
There's a chance this might only be related to Nintendo Japan, and we'll update this post if we hear any news regarding this.

Bit strange. I know some professional outlets like Eurogamer are co-streaming all the big E3 presentations, I guess they'll have to cancel their Nintendo one. It doesn't bother me though because when it comes to Nintendo I'd rather just watch the normal stream with no distractions.

Sounds fair to me. If people want to watch the show they can watch it through the official stream. I think a lot of these 'influencers' see themselves as being a lot more important than they actually are but I am sure there simps here will be more than happy to correct us on that.

It's not like they're stopping live reactions altogether. Not too hard to just get the second stream up on the side. Streamers can still get their easy content and Nintendo can still have their viewers on the proper Direct stream at the same time.

At a guess could this be linked to the expected Smash reveal? Something to do with licencing rights particularly if the music is only licencesed to be shown "live" in the direct itself.

Restrictive broadcasting policy for content that its creator claims to be freely available worldwide at a single point in time (exactly like this Nintendo direct) while not upholding that claim, which is caused by their own amateurish broadcasting execution should always be frowned upon. Because it only damages the rep of the creator and it only shrinks the reach of the art. All fans that pay honest money for the creator games should have easy access to such content. It's mostly a service problem and Co-streaming would not even exist if people didn't need something that was already proved by the creator.

@BenAV if you really think it through you will see their reasoning behind this policy is extremely shortsighted, just like so many other policies they enforce. They gain nothing when (note my choice of words here, I didn't say "if") ppl start having issues getting that access to that content. But this is unfortunately what happens if you don't choose your leaders by their competence and rather do it the traditional shortsighted way. You get exactly the same shortsightedness repeated again and again

Casting aside all the arguments regarding legality, traffic analysis, etc, I’ve never understood the appeal of watching a live stream with someone giving live commentary and reactions unless you genuinely aren’t interested in the presentation being watched and just want to be entertained (Like I should have done during the Ubisoft presentation).
I want to see what’s being shown and talked about, not the actions of some random person acting surprised. I’ll save that for after I’ve watched the stream and wish to compare how some people reacted to certain reveals.

I never understood why a trailer should be copyright protected in the first place. It's literally an ad, the more people that see it the better. Copyright protection should be about something that will damage their revenue not add to it.

I've been watching everything through the twitch channel of a podcast I listen to. It's about being able to discuss the stream in real time with a like-minded community.
I don't know if I'm interested in watching the "raw" feed. (Although it might be at a bad time for me anyway.)

@iuli We can host the stream on the site but we never 'co-stream' any Nintendo event - which is the act of including a livestream within your own stream, which is happening at the same time.
completely agree! Co-stream is not needed and there is plenty of time afterwards to do reaction streams. I imagine many egos will be upset by this but I never stream co-streams as they are awful. I guess phones can’t always watch 2 videos at the same time. Reactions can be posted and watched afterwards though. My guess would be they want an accurate count of viewers or it’s Nintendo being Nintendo.

This is one of the reasons I prefer a more controlled stream. This way, I don't have to deal with the overdemanding people in the chats. At least here, I can have my thoughts acknowledged, without being ignored by scads of pasty, unwashed nerds who rage whenever their favorite character whom they hope to main in Smash doesn't get in! I wonder if this applies to Daimando on Twitch. He has a limited amount of people tuning in for most of his stuff, myself included.

@UndoControl Perhaps. But Nintendo is far from alone in having this "problem"; many media organizations have to do some legwork to establish the true size of their market. How do radio broadcasters provide more-or-less accurate audience numbers to potential advertisers? I'm not shedding any tears for Nintendo here.
In addition, the lateness of this request implies, to me, that this notion was an afterthought. I'm not impressed, and I suspect that those people telling us how NCL has all the rights as a creator are betraying a certain contempt for the public here.

"OMG I can't believe that man is wearing a T-shirt!". They can't be like that when the camera is not on. Otherwise their blood pressure would need to be regulated with medication.
OK, this is not the end of the world. People get bent out of shape about every last thing. The end of the world is when the Direct is released and somebody's long-awaited game has ... motion control. I'm happy I'm able to take 40 minutes off work this afternoon to learn about the new games, and the experience won't be diminished because I can't listen to some 20-something shrieking and cursing over it.
Although I feel for the content creators on youtube I actually get why Nintendo is doing this. First of all, Nintendo is the sole owner and distributor of their own "live" content and they want you the viewer to see and hear what they feel is right for their business and when the live content has been shown others can use it.

Really failing to understand why this is such a big deal. As a consumer, Nintendo will have already tailored the presentation directly to you. It's the games we're here to see anyway, not some wannabe D-list influencer shouting down their microphone at you while you sit there and cringe.
Call me old fashioned, but I've never bought into influencers and streamers anyway who monetise and piggyback off of other people's creations. To me it's unethical and I have no idea why people continue to watch Twitch rather than simply play videogames themselves...

@Razer That's the thing. You keep mentioning "competition". Nintendo hasn't viewed Sony as competition for about 15 years. And it's because of that bubble of insulation from competition that Nintendo can issue boneheaded decrees like this. Why bother competing when the "competition" has ceded an entire, hugely profitable market niche to you, after all?
Edit: That having been said, if I had to guess as to why, it's that Nintendo is going to fly in the face of all of the "leaks" and rumors and not release anything on the "New Switch"/"Switch Pro" here, and it wants to manage fan expectations on that front. Which is going to be harder to do if the information is filtered through unsanctioned influencers.

Joke aside, I don't see much issue here. Sure, you won't see it with your preferred youtuber but it's probably only for a few days. After that it's likely that they allow reactions.
@Yorumi Been a Nintendo fan since Pokemon Red and Blue came out and I can tell you, I feel totally fine about watching the stream as intended. My customer happiness comes from the fact that there's a Direct at all.
It’s funny that other companies try not to use licensed music or have a separate stream without the music to cater to reaction streams while Nintendo is advocating against them. I don’t understand why anyone who is interested in the presentation would rather watch a restream with someone talking over it. I do like to watch the reaction videos after I’ve seen the full presentation though.

This sounds reasonable to reasonable people. Even when I miss a conference I make sure to either watch it on the company's official channel or wherever it was released (IGN, Gamespot, E3, etc.). The least I can do is watch a conference through it's official release for the views. Why would I want to give someone else the views for another company's work? Afterwards, I enjoy watching some of my favorite YouTube personalities lambast the poor decisions some companies make at E3.
For example, I don't know how to classify what Square Enix and Capcom did for E3 this year, but I don't feel that either counts as a conference. Capcom had the worst showing by far, imo.

3DS was their WORST selling handheld console ever and it was only down hill from there.

GBA barely had 3 years on the market before the DS showed up, it sold more units in nearly half the amount of time than the 3DS.

Going to post and then read through all the comments. I'm definitely on the side of this being a very dumb sounding decision from Nintendo Japan. Hundreds of thousands, if not millions, of Nintendo fans ENJOY watching live reactions of their favorite Nintendo streamers reacting to new Nintendo information. Telling these streamers that they can't stream the Direct live with a reaction...but then immediately after the LIVE transmission is over...they can watch the replay and stream a reaction to that...is just stupid. It should be one or the other: either tell people they can't stream the video with their face AT ALL or that certainly they can stream a reaction to it. The decision makes no sense. One of my favorite things to do in the 2 or 3 days following any Nintendo stream is wander over to YouTube and watch the SAME stream over and over again...but as reaction videos to see the love and joy and support that other Nintendo fans show for their favorite (or one of their favorite) gaming companies. To tell those streamers, many of whom stream Nintendo games and gush over Nintendo hardware and software that they cannot react to the biggest Nintendo news event all year LIVE is just a slap in the face. As the article states above, hopefully this is ONLY for Nintendo Japan, or Nintendo is going to be hit hard with harsh criticism from fans.

@Razer the Switch has been out for 4 years, the PS4 has been out for 8. Additionally, the Switch has outsold the PS4 in their home market of Japan by several million units. The Switch is most likely to overtake the PS4 lifetime sales in 2 years, 3 max. If Nintendo launches a significant update to the Switch (you know like Sony did with their PS4 pro?), then they'll overtake the PS4 even sooner.

On the other hand....I actually kind of want to agree with them. This massive content stealing platform known as Youtube is a disgrace, and frankly should probably be legislated out of existence in its current form. It's a giant middle finger to actual content ownership and Google got away with bloody murder in buying a company that was never properly legally challenged because it was the early days of the internet when politicians said things like "the Internet is a series of tubes" (actual quote) because they had literally no idea what it even was. It never should have made it to prime time, let alone becoming part of a corporate behemoth in its current form.
Yeah, Nintendo's out of touch, you can't put the genie back in the bottle. But the bottle should be blown up all the same. And politely asking people to volunteer to do the right thing while the guy next to you takes advantage of the opportunity and runs you over with it isn't going to work outside Japan.

I’m just hoping I won’t have issues viewing the live direct straight from Nintendo, now that EVERYONE IS HERE.
I remember some years back when the view count got to be higher among the viewers appearing to watch the live stream, and I was nearly unable to watch anything(My internet was really great back then). I now have terrible internet service that will go out multiple times a day, so I might have to use my phone’s data.
Seems like a rather trivial thing for people to get bent out of shape over honestly. And that’s coming from someone fully supportive of reaction videos/channels.
Regardless, people will still do it anyway.

@Razer @razer you are right. PS4 numbers are better than Switch numbers. And Switch numbers are artificially higher because we were forced to also buy a lite console to play on the go because the regular Switch is not portable. Nintendo is only doing this to force us to watch the video without any criticism. So when they say Zelda Collection will only be available for two months, they won't be criticized for being anti-consumer. Why do they have to be evil and greedy even on the best day of the year?

I think people are misunderstanding what Nintendo is asking. They are not saying that after the broadcast you cannot upload the Direct with your reaction. They are asking if during the event you link to the official stream and just stream your reaction without the video (During the initial stream) This is a very common practice even in the film industry. This is not an outlandish request. They probably want accurate numbers of people who watched the stream live rather than a projected estimate.
This is not a draconian request this is a rather standard request in Western and Japanese media (if a very generous one. Look up a TrashTaste podcast episode on working with anime publishers in Japan to see how much worse Nintendo could be.)
Just relax you will be able to watch your Arlo, Spawnwave or whoever reaction about an hour after the stream. Or even just load their stream and Nintendo's at the same time.
Nintendo being Nintendo. Shocker. Those of us on mobile can't pull up both the original stream and our favorite streamer's live reaction so Nintendo's just killing hype and ironically, killing the fun.

Look my point is Nintendo enforces a restrictive policy and threatens ppl who want to experience Nintendo's content in their own completely harmless way. This is not a very smart thing to do in the information age we are in, it actually goes against the need of a part of their own fans. And if they can't service the ppl themselves in a way they prefer it is not wise to block others from closing that gap, especially if it only could lead to more fans, more sales and greater broadcasting reach. @ballistic90 I'll come back to this comment in a few months time when it becomes apparent that the end of the stock shortages for the Xbox and PS5 have relegated the Switch to 3rd in every territory outside of Japan.
It's already happened in the UK, the rest of the west will soon follow as PS5 and Xbox stocks catch up to demand.
Don't fool yourself into thinking the Switch would have been selling this well if it wasn't for the pandemic and the stock shortages that have blighted the other two.

This is mildly disappointing, but actually isn't a big deal. Of course, that won't stop the internet from hyperbolically blowing this up into "NiNteNdOoMeD!" But seriously. Come on. This isn't going to hurt Nintendo in any way. Not the reach of their marketing, not the hype about their games, certainly not the sales of their games. It's not like anyone is going to not watch because of it, or that game news outlets aren't going to report on it. Everyone's going to forget about this non-issue in less time than it takes the number 4 to show up in a trailer.
As someone who finds 99% of YT personalities to be completely absurd and obnoxious I do like this.

Of course this does not hurt the billion dollar company Nintendo, but it does hurt content creators and followers of those.
Instead of caring such bulllshit, they better give us a really good e3 show, with tons of games and gameplay.
I'm not sure why anyone would watch someone comment on what they are currently watching for the first time.
I don't know why this would be wrong for some. I, for start, don't like to see an annoying Youtuber screaming and complaining about announcements while I watch a presentation.
That sounds perfectly reasonable to me. Nintendo will be tracking how many people are watching to gauge the viewership. If you are watching a person that is watching it, then there will be lower numbers on their streams. You can upload a full reaction after with no restrictions. Also do you really want to be watching for the first time then have "HEEEEEEYYYYYYYY!!!! WOOOOO!!!!!!" go right over some information?

I like how this board assumes this applies to non-Japanese viewers, which it obviously doesn't since they haven't bothered to make an English version of the statement yet. I think this is kind of a silly decision, but an expected one from Nintendo. I usually don't want reaction videos just because I don't want to hear somebody interrupting the video when I'm actually reacting myself. But I get the appeal of Internet personalities in general.
It's their content, but as always it would have been super nice if they had shared so much as an inkling as to what the reasoning here is. They don't have to, obviously, but then again, they don't have to do public relations - like a Nintendo Direct - at all either.
I think for some people this way it just comes across as arbitrary patronizing by an out-of-touch suit-a-group.

For the people who decide they can't support this practice and must boycott the Direct, I will simultaneously be streaming a reaction video to the Hindenburg disaster.
I'm not interested in whether this is right or wrong but this does mean that I now don't have to scroll through a load of reaction videos to find the official feed so for that reason alone I'm fine with this...

@Bizaster No it isn't. They want to have accurate viewer numbers for their E3 stream. If people watch via another streamer, their viewer number goes down. Having two open means both Nintendo and the re-streamer get views for their video. Both sides win.

People will try to make everything Nintendo does into controversy, it's embarrassing really. Whoever is making decisions over on Twitch is being childish, but it's fine because it's them losing traffic. I've never streamed a video on Twitch before anyway. It's too much of a hassle, and YouTube exists, so... 🤷🏾♂️

@Yorumi yeah i agree with this. going by an example, the Final fantasy XIV dev team have built up a lot of good will for generally being very open with the fanbase and engaging a lot with them.
naturally its a companys choice and i dont think anyone is really demanding things or saying that nintendo will fail if they dont (outside maybe one or 2 people it seems) but it definitely can help with a companys image.
for me personally im going to be watching it via the official channel but i can see why people enjoy watching streamers since it can give the feeling of watching with a friend.

Of course it's fine for somebody to do a co-stream without any of the actual content of the e3 direct in it. Nintendo literally does not have any control over that AT ALL, if they tried to take control over that they would get the easiest to lose court case in history.
Nintendo doesn't want a bunch of weird hot tub streams and people just ripping off their content for their own profit. Nintendo doesn't need influencers to push their Direct everyone and their sister will be hyper analyzing every single frame of the direct afterword.

I really dislike co streams because even the people streaming are just processing what is going on and their input is not good and you are trying to watch the actual stream yourself. It's not a good trend. I always prefer to hear discussions after the fact.
Good, most people don't add anything to the conversation they're just shouting and or complaining... If you watch others to get reactions so you know how to react... you're probably a wasted husk.

@Richnj I say this as if Nintendo is known for it's ahead-of-the-curve innovation and consistent ability to understand the value of things well before the rest of the industry--or at the very least figure out how to implement these new technologies in a practical way for gaming. Things like mobile gaming, motion controls, interactive rumble, AR, 3D, touchscreen gaming, Nintendo is always in the thick of it. They implemented the D-Pad and A-B controller layout for crying out loud. I'd say they've earned far better than to be written off at the first whiff of disagreement. That's just me, though.

For this to be a persuasive argument, Nintendo would have to be flawless in their execution of businesses decisions. Things like the Wii U prove otherwise.

Of course I would, but I wasn't passively arguing that I or Nintendo has been flawless. You were.
And the logic goes like this. If Nintendo has made mistakes in the past, then it's safe to assume they can make mistakes again. Therefore, blocking co-streaming can be one of those mistakes, and your argument of 'trust Nintendo, they know what they are doing' falls apart.
@Richnj I understand why you need my argument to be that Nintendo is perfect or infallible. Your whole argument literally hinges on it. Unfortunately for your argument, that was never what I said. Considering you actually quoted me, it seems odd that you still missed that. I'll try to clarify for you.
My actual point sounds something like this: Nintendo has been doing things differently than the rest of the gaming industry for their entire 40+ year history and that history has shown them to be--more often than not--successful in their choices. So to flat out declare Nintendo is wrong for doing something differently is empirically unwise. You might very well be right that their decision to block co-streaming was the wrong choice. But when dealing with proven innovators, there is no way of recognizing a mistake without the benefit of hindsight, which of course we don't have. And given Nintendo's past, it's just as likely that they are seeing something in a way most people haven't thought of yet.
And be careful with your argument, "If Nintendo has made mistakes in the past, then it's safe to assume they can make mistakes again," because the logic can run both ways. it is just as logical to say:
"If Nintendo has made brilliant decisions in the past, then it's safe to assume they can make brilliant decisions again. Therefore, blocking co-streaming can be one of those great decisions, and your argument of 'don't trust Nintendo, they don't know what they are doing' falls apart."
Anyway, hopefully that helps.

The closest I came was saying you had "passively" argued it. As in, generally touting Nintendo's achievements and using them to justify trust in Nintendo's decision.
But since we're now on the same page as to Nintendo's track record, you can start asking how this decision affects their business and the gaming communities. And since generalities like "there is no way of recognizing a mistake without the benefit of hindsight" don't argue for or against the decision. You might as well say "I don't know" or nothing at all, for what it adds to the conversation. We can ignore any unforeseen circumstances.
So, was costreaming hurting Nintendo?. I doubt it. Probably just made it harder to see engagement. But probably didn't hurt actual sales. Maybe, this decision will really help Nintendo. Maybe miraculously make them billions, and is just really good for Nintendo.
Does removing costreaming hurt the community? Yes. It's harder to build up on communities when you copy strike videos and ban streams of your games. The communities find it harder to build around your IPs. Making communities feel less welcome.
If this decision hurts gaming communities, then the decision was wrong. And short of someone being able to argue that this will help communities in the long run, or that Nintendo has a history of being super pro community, this decision continues to be wrong.

But versus riding around the circle again with you, let's drill down to the core. We agree that you can't objectively recognize a mistake without hindsight. The best we can do is speculate and maybe even even predict with a fair degree of accuracy, but we can't know for sure. For example, you can speculate that Nintendo's decision to hold back the co-streaming/reaction vids for 40 minutes hurt the community. But until you can see something tangible like the number of views on the E3 trailers and reaction vids aren't numbering in the tens of millions per usual--which they still are, by the way--you can't be certain Nintendo did anything but push some YouTube upload timestamps forward a bit. Either way, it isn't even the real issue I have with those choosing to lambaste Nintendo versus give them the benefit of the doubt. It's actually this next part:
We also agree that whatever hurts the community is bad. So then what is worse for the community than going around spreading negativity about a company who has brought us nearly a half-century of joy and entertainment? One who has defined our childhood and given us a venue through which to connect to one another and find common ground. Heck, Nintendo largely responsible for there being a community to be a part of in the first place. But then speculative pessimists want to complain about every little thing and tear it all to the ground. And worse than that, those same pessimists are also in the community asserting that those like me who choose to look optimistically at companies like Nintendo should shut up and sit down. Well, I disagree. Optimism and positivity IS what is best for any community. Period. Now that doesn't mean we have to agree on everything. But there is a HUGE difference between "I don't agree with their decision on this" and "Nintendo is wrong for doing this and totally out of touch with its fanbase."
So sure, I don't know for certain that Nintendo's decision with the co-streaming was a good one any more than you or anyone else know it's a bad one. All I'm pointing out is that if neither of us know, isn't it better to belay the speculative negativity and take the optimistic approach until we know for sure? I think it's a thought worth considering.

I don't need hard figures to be able to decide that something is bad for a community. Any action that limits that community's freedom and choices is bad. Any change to how the communities operate would need to be evidently beneficial or explained how it's beneficial by the one forcing the changes. Since neither seems to be the case, I'm pretty confident in believing the change wasn't done to benefit the community.
Criticism is not negativity. Or at least, decrying criticism as negativity is a really bad argument. We are allowed to criticise. In many cases, as customers, it's our job to. My positivity is reserved for when a company does something right. Even if that something right is 'we are just releasing enjoyable games and not doing anything overtly bad adjacent to that'. Not as a default response to something with potential negative consequences.
I don't need to give Nintendo the benefit of the doubt. I owe them nothing, and they owe me nothing. They put out products and services and I purchase those I'm interested in. That is the absolute extent of our relationship. If you, or anyone else, is anymore deeply involved than that, you should seriously think about reassessing that relationship.

It’s baffling (as in confusing) that Nintendo still seem so behind the times where things like this are concerned. But yeah I really annoyed their E3, thought it was a good show.

But it’s behind in the sense that they want as many people as possible to watch. That might mean catching people who wouldn’t specifically watch it but may see it through their favourite streamer. Cast the net as far and wide as possible.
