they submitted it before in late september and nintendo sent it back, so even after a submission they may still have work to do on the game. for that reason, and i pray this isn't the case, if it got rejected again they may still be working on it yet.
whatever nintendo objected to in the build that was submitted in september took nicals about 1 month to correct. who knows what type of work it could have been; in that amount of time an overhaul of the entire game isn't likely, so it very well could have been a list of little complaints that needed fixing. i'm pretty sure that nintendo would have made it clear what needed to be done for the game to pass next time around, so the odds of nicalis failing a sumission a second time aren't very high.
it's just a little confusing what's taking this much work; the wiiware port is nearly approaching the amount of time pixel took to program the original game in the first place.

Kinda wondering the same. I was on their website a few days ago (forums as well) and no announcements had been made regarding the game in quite some time. It's pretty sad that Cave Story was rejected, but we still get the likes of Happy Holidays: Christmas.
Edit: Speaking of their forums, there seem to be some pretty angry/douchey people on there.

no review or demo needed. you can download the original cave story for free right now and see if you like it or not. the wiiware version was overseen by the creator of the original and should be very faithful, with extra polish to the graphics and music. even if you don't like the lightly 'upgraded' version they'll include the original, untouched version of the game, so if you like the freeware version at all there's really no way for this to fail. i've got 1000 wii points just itching to be spent on this game.
