of course as they're now playing 'its not my fault, its the other guy's fault' game..you could file a claim against them both, though as Sean_Aaron pointed out, from start to finish of the order process..nintendo's in control, and owns the partnership, thus its not on the end user to be responsible for something they couldnt possibly influence unless they tried hand delivering the system to the support center.

I have to admit I am curious about how this case ended...

I work on xbox, and part of my job is investigating this kind of cases

and in this case it is UPS fault, since the console disappeared by an agent they hired, that means the responsibility belongs to their hiring methods, simple as that.
big companies can help you with the process (in this case, Nintendo), however, they are not responsible of these situations, since the package never arrived....

I had a situation where I ordered something and apparently after multiple failed attempts the seller requested a return. Now I had never received notification of delivery attempts because the delivery agent apparently couldn't read and didn't bother putting a notice through my door. The seller tried to somehow blame me, but I pinged out that they should at least have contacted me before requesting a return so I could contact the shipping agent. Citizens Advice Bureau (UK non-profit that gives advice on all kinds of things for free) said that given the delivery agent wasn't engaged by me, it was down to the seller to resolve and I got a refund from my credit card company as a result.

I'd say the same rule applies here and regardless of whether or not UPS is as at fault, it's not down to the OP to make a claim with them because he didn't arrange the shipping and doesn't have a contractural relationship with them.

I'm also interested to know how this turned out.
