If you do nothing about it, then yes. However, you can have the console repaired or replaced. I think the repair centers under Nintendo are capable of transferring your downloads to another console. There is a chance that you could lose your downloads during the process. Hopefully someone who got their consoles repaired can actually confirm this.
Even then, I'm sure that sounds like an anger-inducing inconvenience for many. I really hope Nintendo can tie accounts to a user's ID. I really don't like the way they worded the statement...

Nintendo makes sure your downloads are safe. I've had a Wii fixed, and you just need to redownload them when you get it back.

And with your questions answered, you are likely angry at this situation and regret your purchase. With the fact that you transferred your VC games to the system, this is a tricky situation because it's virtually impossible to return for a refund or sell it without losing your games. If you decide to keep it, we hope your experience with the system gets better.
Now here is a consumer's wisdom that will hopefully help: approach potential purchases cautiously, examine every aspect of that product, make questions that are important, and conduct some research. Try to also know and stick to a brand you're comfortable. If you at least need to know about a brand, do research on that brand and be aware of their good side and ugly side, like this:
Good: Nintendo is friendly with families and produce various games of excellent quality. Ugly: They are stubborn and behind with the times such as an archaic online store system
When you are making a purchase from a brand, especially be aware of their ugly side.
