I guess it's probably because they aren't very popular despite being free to play. With Wii Street U, I believe it was promoted quite a bit when it was first announced.

Edit: never mind, I forgot free games aren't included... (I wonder if Wii Street U includes the sales for when it was free and how many there would be without them)

I updated the Canadian and Japanese lists, a couple of games shifted a little bit and Xenoblade Chronicles X is now currently 15th on the Japanese eShop.

Free games are not listed because they are free. The Top X list is only for paid titles only (no DLC either of course). This theory is actually easy to show. Indie game "Lucadian Chronicles" is free too and has gotten a lot of downloads. But is not on the list. View the Indie page on Wii U eShop in USA, you will notice it's usually near the top. That list is ranked by recent download numbers.

The reason for this is likely to not clog the list down, esp since being free attracts a lot of downloads anyways.

Btw. download codes actually count towards the list as well.

Wind Waker was an early eShop release, it came out 2 weeks before the retail release.

Updated once again, overall there were some minor shifts with some software, but the biggest thing is that Splatoon has already beaten Dragon Quest X for the top spot despite only being out for a little over a month!

Updated, for Canada there weren't any new games, but Mario 64 got a decent boost while Wii Party U went down quite a bit.

For Japan there weren't any changes, but since Brain Age was released it is now at 9th. (It was offered for free last year for a bit, I think Europe also got it)

Updated the list for Canada and Japan. There wasn't much change, but while it wasn't as much as Splatoon (which made it into 2nd), Super Mario Maker made it into the top 10 at number 8 for Japan.

It's been awhile since I updated Canada and Japan so I just did so now.
In Canada, Mario Maker is currently sitting at 13th and Splatoon has made it in at number 19.
For Japan, Mario Maker is at Number 4 and Minecraft: Wii U Edition has already made its way to number 9.

@jariw: none of these lists are truly accurate tho. The count fee and discounted downloads. So every time you get a digital vc game from club Nintendo it was counted. Don't forget about the 30 cent vc game promo for the first six months the Wiiu was on the market.

@faint ya that certainly seems to still be a very popular game, though the 3DS doesn't have it, Cube Creator 3D is 12th on the Japanese 3DS charts.

Several changes since I had last checked.
Wii Street U which was 6th on the Canadian eShop is now gone now that the software is no longer available due to it being cancelled in the near future. Mario Maker has made it into 6th place on the eShop however. Also Minecraft is now 14th on the eShop and has also made it into the first position of the Japanese eShop beating Splatoon for the top spot.
Mother 3 is currently in 18th.
