One of the biggest problems I have with the American patent system aside from how you can get a crap patent approved which is basically a circle on a piece of paper that says "You know, for kids!" on it is that you don't need to leverage it. I would expect at least a prototype applying a patent within, say, two years of issue or else the patent shouldn't be enforceable and voided upon any attempt to do so. I seriously doubt Philips has done anything with the patents in question or we'd have heard about it and they would indeed be getting license money from not only Nintendo, but Microsoft and Sony as well.
