Because they own like 99% of Monolith now.

Is there to was though when even at like of than with it?

Xenoblade yes because that game was made while they owned Monolith Soft. Baten Kaitos probably because when the second one was made, Nintendo published it and there was no mention of Namco Bandai in it.

They own all of Monolith. They own Xenoblade, but not Xnogears or Xenosaga.

the thing is that Xenoblade is a spiritual successor and is, at least legally, not connected to previous Xeno games, so Nintendo can own the IP since you can't own the copyright for every single thing that happens to begin with xeno.

Interesting. Well Xenoblade was previously called Monado...so it only has mild connection with the previous Xeno series.

Wouldn't the rights to Baten Kaitos depend on if Monolith has joint ownership?

A xenosaga collection was released on the DS, Xenogears is owned by square, Baten Kaitos origins was published by Nintendo. Monolith soft owns the Xeno series (Xenoblade and the upcoming Project X for Wii U)

If they can, I would like to see Nintendo and Monolith surprise us with a new Baten Kaitos at next year's e3

You know its pretty interesting. I've looked through the games all three have published these past few years and while Sony and Nintendo own pretty much everything they put out, I've seen five Microsoft published that they don't own. Including an Xbox One game. You would think they take the rights to what they publish considering anything could potentially break it big.

I find microsoft normally pays for exclusive content more often then exclusive games. This could be where nintendo is having a hard time. Devs now expect to be paid for exclusive content where the GamePad almost forces exclusive content (mainly talking about second screen content)
