That's why I'm saying you'll be fine, as long as you downloaded it when it was available. Is the eShop encouraging you to download at midnight? They might be strict and not allow you to get the free game, and you'll just have to deal with it, but I don't think they'll do that to anyone who downloaded it. All you can do is wait and see, then call Nintendo if it doesn't happen.

Tasuki is right. Even if they make no sense, you should read the terms and conditions. If you didn't, you can't really complain about them after the fact. The only thing you can do is request the code anyway, and if they comply, then the problem is solved.

I love how people call you a troll when you are right and they can't come up with a good counter to argue with.

The point is any offer you look at whether it's from Nintendo or whoever there is always a little * buy the initial offer. Mainly cause they would put all the rules and regulations for the offer it would take up to many pages. Why do think they have fine print to prevent mess ups like this from happening,

Well then you might as well go live on a desert island or something cause all companies have fine print and require you to read it. That way it covers their butts if there is a problem.

Why are we taking you seriously?

Also, all promotional material I have seen for the Bonus Game Promotion has been subject to terms and conditions. Those terms and conditions have the times listed on it.

@Scar Not sure about what NA's T&C are, NOAU have the times listed as between 31st May 2014, 00:01 AEST and 31st July 2014, 23:59 AEST. It clearly states 10am in Europe, and therefore the OP shouldn't get his free game.

No need to boycot Nintendo afterwards, maybe you should learn to read T&Cs.

Tell me, is there any reason why I shouldn't be included in the offer? I spent the 60 bucks on MK8 - even in the eShop, the place where Nintendo gets all the money without any retailer in-between. Seriously, if a company starts being that narrow-minded, why should I care staying a customer there?

Call me dumb, call me lazy, I don't care. What I care about is where my money goes, and after six years of only positive experiences with Sony I might need to go back to them after such a problem within just one year back with Nintendo.

To conclude this thread so far: It was my fault. I am to blame. I should read the terms and conditions. But I don't want to - and that's my personal decision. And the next days decide where my gaming money goes for the next decade.

The thing is that I think I deserve it - after all, I spent the €60 required. And that I wouldn't have bought MK8 in the first place without that bonus game offer. I don't care about whether it was my fault, what I care about is how the company deals with such situations. I know from experience how other companies dealt with similar situations, and I hardly ever got negative respond. If this will be one of the negative experiences, I have zero interest in dealing any longer with that company.

Yes the reason you shouldn't be included in the offer is cause you couldn't follow directions. Plain and simple. Yes you did pay $60 for MK8 but you didn't register it in the time they said too. Yes it was your personal decision not to read it but why should a company treat you like someone who did follow the rules? What's next are you going to go speeding down the street running a red light cause it was your personal decision not to follow the rule? If you get caught should the cop not give you a ticket just because of your personal choices? What then are you not going to drive in that city cause they are narrowminded?

So you go to Sony and what happens when you fail to go by their terms and condition you going to go to Microsoft then?

Wow are you a piece of work. You spent the 60 dollars or whatever the monetary system is called in your country for Mario Kart 8, and you got that. You are entitled to nothing more.

You're not required to read them, but you are also not required to be given services when you did not fulfill your end

In my experience dealing with Nintendo they tend to be very understanding, it's kind of ridiculous this offer wouldn't be made available immediately after launch tbh. I'm sure if you talk to them you'll get what you want they won't screw over a quick adopter of the game over semantics as the spirit of the promotion is to encourage early adoption, yeah you should have read but most people go off the gist of things and not full details so i'm sure this is a common issue they're prepared to deal with. I'd be rather optimistic if i were you, if they don't want to co operate you can always throw out the "you won't get my business anymore" with a stern but not rude tone, those are the magic words when dealing with customer service. Some of the people responding to you are in my opinion awfully petty and full of themselves over such an understandable mistake, i'm sure Nintendo won't respond with the same amount of repugnance and lack of empathy that these apparently perfect people have.

As for Sony, I had some similar cases and they always did the right thing - treat me like everybody else in the respective offers. If a company isn't flexible the least, well, that's not a good thing.

This is all about personal preferences. And I like Nintendo's products. After all, I grew up playing Nintendo games. But the one thing I don't like are companies who punish their customers for slight mistakes. If that's the direction they go, then there are other alternatives.

THANK YOU! Yeah, this thread gets kind of ridiculous ... Probably because it's now 3 a.m. (or how late it might be where you all live). I just play Lego Batman 2 on my Wii U and have fun so it's not like I'm full of hate or something. I just tried to make clear what I expect from Nintendo, a company I spend hundreds of bucks year after year.

Lack of empathy? The poster clearly said he did not read the terms of a promotion and still expected service. That's like asking me to give you $50 for a service when you didn't follow my instructions that I clearly gave you.

You should actually take the time to read the terms and conditions of everything. You'd be surprised to find what's in the terms.
