RARE are owned by Microsoft and wouldn't permit such a game on a Nintendo console.

Think of it like this: would Nintendo allow Retro Studios to put a Metroid game on the XBOX? Metroid is as much a [Nintendo] property as Banjo Kazooie is a Microsoft property.

I'm no expert on this but I would guess that since the N64 version was released on Xbox Arcade then Rare must own the IP, not Nintendo.

I think you got a bit muddled in your analogy there - Metroid is definitely still a Nintendo IP.

@cronishlee Since Microsoft owns all of Rare (unlike a part of Rare like Nintendo had) they are a first party studio. So Banjo might as well be a first-party IP.

That's kind of what I thought and what I was getting at in my post but really, as I say, I'm no expert in this and it all depends on what IPs were retained by Rare when MS bought Nintendo's shares. The fact that Kazooie is on the Xbox arcade would suggest that that IP, in particular, was retained by Rare and not Nintendo so is now a MS property.

The "spiritual successor" could be on the Wii U but some people seem a little confused by what that is. A team of ex-Rare employees were the ones who talked about creating a spiritual successor, so t would not contain any Banjo Kazooie characters or icons. It would, at best, be a similar style. The team that supposedly may be working on it are free to design it for whatever system they want, and my guess is, if it does end up being released, the Wii U and 3DS have a fair shot. The team that was interested in the project seemed to have agreed that Rare shined best when on Nintendo systems, and they were a part of the company back then. Still, the comment made about the potential of a spiritual successor was hardly confirmation that we'll ever see the game. Keep your fingers crossed but don't get too excited unless we see any real confirmation.

Like ShadJv said, if it's a spiritual successor, then Microsoft has no rights to it because a spiritual successor is not the same IP, it's like when Rare made Perfect Dark, which was the spiritual successor to GoldenEye, both two different IPs. These exRare employees are free to make whatever game they want provided it's not a direct sequel to an IP that Microsoft owns, but they can still make a game similar to Banjo-Tooie using a different story and different characters.

Most likely they're going to put it on Nintendo's systems, especially after the way Microsoft screwed them over, I don't see why'd they want to put it on their system.

Ya, the REAL Banjo-Kazooie is dead. Microsoft just wanted to show off building custom cars with little platforming using iconin characters with good graphics. Once Microsoft lets a Banjo-Kazooie revival happen(I'm sure it wouldn't be called threeie), it will be a good day.

Does the Studio even want to make Banjo-Threeie anymore? I'm pretty sure everyone who worked on prior BK games are all gone. Not only that, but it's gotten to the point where the fanbase is insatiable. I don't think anyone, even Rare itself, thinks it could make a game that won't disappoint most of the fanbase.

Rare has shown interest but after Nuts & Bolts, Microsoft basically decided the fanbase isn't large enough. They're nuts (pun intended) because the truth is the game itself didn't appeal to that fanbase. I enjoyed the game but it was no Banjo-Kazooie. I believe the original two titles sold well on XBLA, but they likely chalk it up to nostalgia and consider the collectathon games from the N64 as a dead genre, Adventure games as a whole are simply less popular these days and, unless you're Mario, they aren't as profitable as, say, the FPS genre. At the end of Nuts & Bolts, Kazooie got her powers from the first games back, which many fans tried to use as a hint for a more tradition sequel but it was followed by a line inferring we might not see another BK title. The sad truth isn't that Rare abandoned the series as much as Microsoft did, and they seem uninterested in resurrecting any of Rare's old IPs. And, to be fair, they probably are right in their decision, as the talents that created Rare's old gems are long gone from the company.
