If your wii shop channel history was properly transferred, you should be able to redownload it for free. Give it a shot. If not, Nintendo support might be able to help you if you complain enough.

Not that it doesn't suck but you haven't mentioned if you transferred anything else and whether or not that's ok, or if this was the only game - remembering you need to re-download it (but you willl have the save files) - and that maybe you didn't follow the instructions....

Nintendo are poor when to comes to customer service..
When I sold my old 3DS for the newer 3DSXL before realising I need them both at the same time to transfer content over which btw is stupid imo.
I then emailed Nintendo about my situation saying that I wanted my games and content I bought from eShop on my old 3DS transferred onto my 3DSXL, guess what they said no. Even though I linked my club Nintendo account to my new 3DSXL which showed when I registered my old 3DS and the eshop content. If that wasn't proof I had credit card statements too for further proof of my purchases.
In the end I told them to go F themselves. £100 of content lost because Nintendo wouldn't help me transfer my content that I payed for on my credit card. Dont get me wrong I'm still a loyal Nintendo fan but I was disgusted with the customer services and there unwillingness to help.
@O.P - bottom line is they won't refund you no matter how much proof you provide.
@BassMonsta If you linked your account, you should be able to redownload your titles from the eShop. At least, I think that's how it works. Also, your SD card should have all of your games on it.

I thought the same but sadly it doesn't work like that. I used the same details from my old 3ds but I couldn't download anything. I had to repay which I wasn't going to do.

Yes, but Club Nintendo has NOTHING to do with the 3DS, except that you can get coins from your 3DS. Besides that, there is nothing you or Nintendo can do. Why doesn't it link? Well, someone could log out of their account, log in to yours, and you would be able to get every game they had. So Nintendo would make no money from the eShop.
BassMonsta, customer ignorance is not the same as poor customer service. Nintendo made it clear you need both systems to transfer content before the XL was available for purchase.

Moral of the story, read the freely available guides Nintendo provides, about transferring data, before you go and sell any system. I have a 3ds XL and it was the first thing I read before selling my 3ds. You need both to do the transfer, which to be honest makes a whole lot of sense. There's a whole load of information about transferring from Wii to Wii U for example, the do's and don'ts and what you will gain/lose.
Sorry you lost your games but a little foresight on your part, would have saved you a lot of trouble and you only have yourself to blame, rather than Nintendo.
@xBASSxMONSTAx: Yep every here as stated what I am thinking too. For weeks Nintendo said that you would need both 3DSes to successfully transfer all your data. Heck it was even stated here on NL in several places alone. Its not there fault that you were ignorant and didn't pay attention. Plus if it that was the case why didn't buy your old 3DS back if that was the case once you found out?
@OP: Dont listen to xBASSxMONSTAx Nintendo has excellent customer service. And I believe like people are saying that if you downloaded it before you should be able to redownload it again once you get everything transferred.

Nintendo does have great customer service. I had downloaded Majora's mask off of the wii shop channel. For some reason, the game wouldn't let me start the actual game. I called Nintendo and they refunded me my 1000 wii points.

I wouldnt say that its a bad rep more like company politics. If they gave all of your games back for free because you accidental sold your system and didnt know, whats to keep a dishonest person from saying the same thing? Look at it this way I sold my 3DS to my friend without transferring my games. I get a new 3DS call Nintendo back said oh I didnt know and than bam they give me back all my games free. Well than my friend sells his 3DS to someone else picks up another one than calls Nintendo and bam more free games. You see where I am going with this?
Today customers are alot more crooked than say 20 years ago and companies need to be on the lookout for that. There really is no way for them to tell a scammer from a nonscammer so they have to treat everyone like a scammer and come up with these rules and sadly in the end its we the honest customers that get screwed. I do feel bad that you lost everything but its a lesson learned.

Doesn't it just leave LostWinds on your old Wii after the transfer, in which case, you haven't actually lost anything? I really would like to know if it's just a glitch or they'll eventually make the transfer for LostWinds possible though — seems very strange that it's the only WiiWare game we can't transfer and that we can even transfer LostWinds 2.
