I'm not against the idea... but have two huge issues with this idea.
(1) Policing the patches isn't just to make sure that content isn't objectionable, but to ensure that (a) they aren't supporting copyright infringement of properties from other companies and (b) the patches don't do things thing aren't supposed such as brick consoles or allow other hacks to be implemented. (2) I can't see how it could possibly make enough money to be worthwhile. As Sean mentioned, there probably would be a small core group of people who LOVE this, and would consider it invaluable... but the vast majority won't care that much and would rather play a professionally developed game than try to sort through user-generated content anyday.
Also, how many companies are really going to want to open up their classic games so that anyone can mod them? I'd bet slim to none for a variety of reasons, not the least of which they want to maintain control of those franchises and the images associated with them.
But hey, dream on! It could be really cool if it ever did happen... you are probably better focusing on PC gaming if modding and patching are your interests though.
Well, I did find the weird outfits I saw on YouTube for Tomb Raider Legend interesting. I'll need more schooling if I'm gonna make my own patches though, ejamer.

You mean like "Reggie" the new level editor for New Super Mario Bros. Wii? Imagine being able to create your own levels? Yeah, not gonna happen...legally anyway.
I don't think Nintendo should be policing the patches. There should be an agreement that would be signed by the users before using the program that disclaims Nintendo's responsibility for whatever material, no matter how objectionable, is in these patches.
If the content is available for download and Nintendo is hosting it there's no way they'd risk "objectionable material" being in there. I suppose if it was strictly in the form of small files you could trade with friends it might work, but given the pace with which normal VC releases happen I cannot see them being bothered about creating a framework to allow modding of them.

Also, if I'm a game developer, I want people to play MY game, not allow some average joe change it to his heart's content. All of that work for nothing in my opinion.

For instance, some Wii racing game developers think the Wii remote should be the only steering option because that's the way the developers prefer. I would have bought ExciteBots if not for this.
