@Waluigi: Wait....what do you mean used to devs being open minded? I mean yeah, maybe someone like Capcom is but there's few companies who do that.

So if the fan work is free and is better than the real one, then what's the point of supporting the real one? What benefit does it do for Nintendo to leave the HD SM64 port alone instead of turning it down?

Why that becomes a rant is beyond me? What do these little fan projects actually do? I get fan translations because of some games nearly being impossible to get it localized but an open source Super Mario Bros browser game? Super Mario Bros Crossover? What does it do in the end? Why oh why rant about shut down fan projects like that?

@AlliMeadow: So you know that Mario coin sound effect that is used? Well now if Nintendo can get it back as a trademark, then people will rant about it even though its Nintendo's own thing. So can you say that it isn't fair for Nintendo to do so or that its fair but Nintendo shouldn't do it because it acts as a "preserve"?

After so long...I'm back. Don't ask why

@Socar: As far as I know it wouldn't be possible to claim copyright on two notes played by an instrument. But if it is possible, then sure, why not? We have a huge problem with copyright infringement, and I am glad there are companies taking a stand.

@AlliMeadow: But I don't get it.....why didn't Nintendo patent the sound effect before releasing Super Mario Bros?

I think companies should be more positive towards fan works. I mean, they keep people interested in a series after the regular games and media wear out their welcome, and inspire people who lost interest in a franchise to come back and try it again. The stuff on sites like Mario Fan Games Galaxy and SMW Central has kept me a fan of the Mario series even during its darkest times (read, Sticker Star, New Super Mario Bros, etc) since they showed me what the series could be.

They also tend not to take away sales from the regular games or viewers from other media, since the people watching or playing fan works tend to be the most dedicated fans of the series to begin with. There's a heavy overlap between the scenes for SMW, SMBX and Super Mario Maker.

I also think companies should be willing to actually support certain works when they get a large audience. If people want a Waluigi game, and Psycho Waluigi actually exists, it'd save Nintendo a lot of time and money just to make that the official product. The reviews are already highly positive (like, 90%+ review score average).

That's one thing Valve did really well. When they saw a mod or fan work that was drawing a large audience, they turned it into an official game rather than shutting it down. See for example, Counter-Strike. Or Day of Defeat. Or Team Fortress.

Embrace fan works and fandoms, don't try and attack them.
