Indeed. It's one thing to say that Move takes most of its ideas from the Wiimote (which it does) but quite another to call it copyright infringement. Nintendo would have jumped on Sony from day one if that were the case.

not copyright. copyright is something else. A design patent infringement however seems likely. There can be a million reasons why they chose not to sue for royalties and a million things that perhaps went on behind the scenes.

@mnementh: why would Nintendo not want to stop a competitor from selling a similar product? especially since, if it really is such a blatant infringement on their own technology and patents, by doing nothing they risk losing all right to similar prosecution against other infringing companies.

what are tin hats for? blackddagon, in the real world companies have many considerations whether to proceed with lawsuits or not. for example, when you proceed with legal action, your patent may be challenged even though it was previously approved by the patent office. It's just speculations but thinking that's not infringement because Nintendo didn't sue is without any basis or reason. I've studied patent law. Nintendo doesn't risk here losing - they have a few years to sue even here if they decide so, of course considering other issues like PR.

when they announced the sub controller I was sure it was a joke by someone ridiculing Sony - it's too embarrassingly identical concept of using separate hand for an analog stick controller.

@mn: Do you not recall all of those lawsuits against Nintendo by those companies (that no one's heard of before) about design and/or patent infringements? Yeah, despite the technologies being similar, they are not the same, and therefore the lawsuit will end in a loss against the suing company

if i were you, i wouldn't bother holding your breath on that.

also, tin-foil hats are a popular conspiracy joke because there are people who honest-to-god believe that they will ward off Big Brother's brainwashing/microwaves/the Evil Eye and all that, just as there are people who honest-to-god believe that Nintendo will attempt to bring a lawsuit against Sony for using a completely different technology in their own motion-sensing controller.

never said that they will. In fact, I've explained to you they might not. Just that there's an obvious use of the same separate analog stick controller used in conjunction with the motion controller. Putting buttons in different places doesn't negate that. Honestly, try reading the post next time. and for the record, blackdragon, users repetitively calling people fanwhatever are personally attacking, just that you know for future use with other users. anyway, done here.. too repetitive.

While the lawsuits are flying around, Sony should totally sue Nintendo for design patent whatever copying the Dual Shock with its Classic Controler Pro. I mean cmon - airplane design, four face buttons, two sets of shoulder buttons, two analogue sticks in EXACTLY THE SAME POSITION.

Clear ripoff. Nintendo makes me want to vomit they are such an immoral copy company.

I agree. I'm done arguing too. It takes too much darn energy.

There was a media event for Move last night, and though I wasn't able to go, they were giving away the Move for testing, so I had a bit of a play with it this morning, and it reinforced my thoughts on it. It's good. On the other hand there was a different one a few nights back where I got to play with Kinect, and it's awesome too. Dance Central proves that it's finally possible to have a real dance game.

I don't think either of these technologies can "win" - frankyl if you have both consoles, you should be getting both.

I played Kinect at a fair in my town. (I have no idea what is was doing there, I call it the Massachusetts White Trash Convention) but anyway, it works and all the dashboard stuff is cool. However, the games didn't work so well and were very frustrating.
