I'm sure they are. My GameStop is still one that gives opened games though. The last time I bought a game from them "New" they didn't even put the game in the case properly. They just put the game inside of a paper sleeve into the game box and put it into a resealable plastic sleeve.

Well, as much as I hope they sue GS and win, I'm sorry to say I won't stop shopping there. I pre order all my games from there, it's the only place I sell my games, and I think they usually have a very good selection. I'm just not one to boycott a store based on corporate decision, especially one that doesn't affect me.
I've been told they're not providing the cases for used DS/3DS games any more. I haven't bought a used DS game from GameStop in ages so I wouldn't know.
They still have the cases for the games, so long as the previous owner trades it in with the game.
BTW, the opened new game thing has only happened to me or my brother once, thank goodness. D: I went to give it back and they gave me a sealed copy with everything included. I still think it was just a mistake.
They make you call an outside company and mail them your defective games, you can't just exchange them in-store.

Ok maybe I didn't say the right word then. Defective =/= damaged by the user, I know that. I should have stated that more clearly.

Stunts like that with the coupon and the open games are New are the main reason I stopped shopping at Gamestop years ago. I buy all my games from Amazon.

Square Enix said they hadn't made GameStop aware of the coupon and therefore are understanding of the right GameStop has to remove the coupon, since the retailer, in effect, never agreed to sell it. By not making GameStop aware of the coupon Square Enix may well have even breached contract with the retailer.
Square Enix did not publicly agree with the practice at all.
It is a business move for Gamestop, for them to not promote there streaming gaming competors, Gamestop is making there own streaming service right now. But part of this is Square Enix and OnLive's Fault for not telling Retailers about this in advance, because the OnLive Coupon is not only hurting Gamestop, but also all other game retailers.
Also I've stopped buying from Gamestop for a while now, and just go on Amazon.com or to Target.
Opening the games and removing the codes is not the correct action on their part, however. They have no rights to these codes and as such should be returning every last one of them.

Well it appears in an attempt to make amends for what they did Gamestop is offer a $50 gift certificate and a Buy two get one free game coupon for those who purchased Deus Ex Human Revolution on PC. Not sure if that covers future sales of the games or just past ones that had the coupon ripped out of it. If you are one of those people who did buy it and had the coupon taken out you just need to present your receipt to get the same store that you bought your copy at for your gift card and free game coupon.

Yes, but I'm much more familiar with gamestop, and it's far more convenient than Best Buy. Besides, I don't always want new games.
