@SwitchForce I can’t believe you are trying to argue this. The sheer amount of examples of this happening on Google is evidence enough. There are detailed accounts posted online. People have posted pictures. If you even bothered to read any of the Google results, the very first hit is someone who posted on Nintendo’s official support page about it, and Nintendo’s own employee responded that requesting chargebacks leads to permanent suspension.

It is incredibly dangerous and selfish of you to recommend someone to dispute a charge from Nintendo just so you can “win” an argument online. That person’s entire Nintendo account hangs in the balance.

Yes, there is no need to involve another party. If I buy something without having a closer look on EULAs, it is my fault.

Even if I wish that Nintendo leaves the „middle age“ of online licensing, this is an interpretation of laws.

Your best bet is to call them again and calmly explain the situation. Nintendo support is generally pretty understanding about that stuff, and they might be willing to fix the situation for you.

In EU and UK that is not legal. If you contact them they should refund you and if you sued them you'd win. No seller can tell you that if you purchase from them then you are are cancelling your legal rights especially if you haven't downloaded nor played the game. That clause would be considered illegal in court because Nintendo doesn't give you a choice. Nintendo is so shady and, like other people said, the bank has nothing to do here, it's the seller who must issue refunds. I would call Nintendo and threaten to sue them if necessary.

If he really wanted to play it, why not buy an SD card? Micro SD cards up to 128 GB are dirt cheap these days (about $15 in the States). Would probably be easier than going through a legal mess
