Gonna copy paste the message I posted on the Nintendo tech support forums:
"Hey all,
So it hasn't even been two hours that I've had the New Nintendo 3DS system that came bundled with Animal Crossing Happy Home Designer. This is the standard sized N3DS. I do have the N3DSXL, and I wanted to transfer my data from that system to this new one. I went through the initial setup for the N3DS as normal, and then for some reason, when it directed me to the home screen, my touch screen stopped working. This is an enormous problem because instead of being able to access the home screen, a message pops up on the home screen advertising the Theme Shop and the only way to get out of it is to tap the Next button, which I cannot do because the touch screen does not respond to anything. I am basically stuck with a bricked N3DS because I cannot do anything if the touch screen doesn't work. I called Nintendo and they weren't very helpful, suggesting that it was just debris stuck in the screen even though this is a brand new system.
Is there any way to fix this? Worst case scenario, I will go and exchange it for another bundle, but it's such a hassle for me to do so that if there's any other way at all for me to fix this, I'd like to explore it. More specifically, if there is a way to factory reset the system without having to go to the system settings, that would be ideal. I read that this might happen if the system is turned off during the initial setup, which I don't think I did but I highly doubt the touch screen is physically broken. Please let me know. Thanks!"

"As I've said, the only way to advance past that screen was to tap "Next." The problem seemed to fix itself later, however, randomly while using the system, the touch screen would stop functioning, along with the ABXY buttons, d-pad, circle pad, and LR buttons. Additionally, the 3d slider and volume slider would also stop working. I've documented the problem here in a YouTube video, hopefully this clarifies the problem more. My 3DS is currently completely unusable because the problem has not stopped in several hours."
It's been almost 48 hours since I've had the system and the problem keeps going away and coming back intermittently. Most recently, it happened when I was in the middle of playing Happy Home Designer and it hasn't recovered since. This is really frustrating as this is a brand new system and it seems to just have been defected right out of the box. I've already transferred my system data and have to wait five or six more days to transfer again, but I'm not sure if I'm even able to do that because I can't move the controls on the 3DS at all, so how would I get to the system transfer menu? I'm afraid of sending it in to Nintendo because I have immense amounts of play data on this thing from when I owned the original 3DS back in 2011, and I do NOT want to lose my data. If there is ANY way someone could please help me with this or point me in the right direction, please let me know

As I stated, it was like this straight out of the box. No protector. I've explored all physical possibilities and this is not a physical problem. As I also said in the rest of the post, it's not just the touch screen. ABXY buttons, LR buttons, start, select, d-pad, and circle pad all don't work.

Best bet is to contact Nintendo and set up a repair, if it's indeed brand new one and hasn't been modded in some form then it should cost you nothing as it's under warrenty. That would be the safest route to take so you don't lose any data.
