My 10 year old daughter created her Nintendo ID a couple of years ago when I bought her 1st 3ds xl. She put a bunch of random things in for her ID, password and e-mail. I recently bought her a "new" 3ds xl. While trying to transfer he sd card data from the old one to the new one we encountered an issue. So I call the Nintendo customer support hotline. What could have been an easy fix of resetting everything turned into them deactivating her account all together due to the COPPA or Child Online Privacy Protection Act. She now has lost all of her information including all of her e-shop purchases. Which after spending all the money $200 for each 3ds xl, plus $30+ for games plus I don't know how much in e-shop purchases, does not make me a happy customer. The 3ds xl has parental controls on it which were implemented. This was completely unnecessary. This is a product for a child. Kids are going to put random things in like that. Most kids do not have the patience to carefully put in passwords and correct birth dates. Now my daughter has 2 3ds xls that she cannot use the way she is used to because some tech support guy deemed it so. Good job Nintendo. Thanks but no thanks.

That certainly sounds frustrating, but this is a enthusiast site based in the United Kingdom with no official affiliation. The community here wouldn't be able to help you with that.

This doesn't really seem like a offense on Nintendo's part though. They have to act in compliance with COPPA or risk heavy fines from the FTC, much like Xanga did in 2013. Companies are not allowed to collect personal information from children under 13 without parental oversight, which by your own admission, she did not have. A tech guy didn't deem it so. The US government did. While the act itself may be poor or flawed, as a company with such a large user base under 13, Nintendo must take it seriously. Write a letter to your congressman or organize a lobby group to have the act changed, if you don't support it. Not much else you can do.

You should still be able to recover your eShop purchases though. Have you tried calling support again? Escalate the issue if you need to.
