I am about to get a New 3ds XL, my first in the 3ds family. I have been playing SSB4 a lot on my brother's cartridge copy. I plan on getting a digital version. So my question is, would it be possible for me to copy my little brother's save and use it as my own? I really don't want to have to unlock everything again.

You can. The 3ds has a transfer application in the eShop somewhere. The problem is, I don't think it just copies the data. I think it transfers all the data. So that means the cartridge will be erased and your little brother might have to unlock everything again but I'm not 100% on that.
