If I ever do Let's Plays on YouTube, it won't be for Nintendo games. Worrying about fees and such just doesn't seem like it'd be worth it.
Actually it seems that Nintendo only cares if you make revenue for it. I don't know if there have been cases of videos being flagged (not counting the supposedly broken Youtube system) when they don't have ads

I mean, there are some people who view videos just for the story, so why don't they remove all elements of the story from the video? To me, it seems like a way better compromise than this.
But that's just one man's opinion.

I do agree this is silly, but again, I don't really think this will have any affect to current Youtuber anyway. It might, Nintendo might go full stupid, I don;t know, but it seems like its own thing that most people at worst, can just ignore.
Look at it this way: people who sell remixed songs have to pay Nintendo a cut because of royalties.
This is kinda the same logic. They are still profiting off someone else's work, and quite frankly the IP makers deserve a small cut. I really don't care that this is someone's living. They have to follow rules and guidelines like everyone else and they need to drop this entitlement attitude that some have seemed to develop from this YT living.
At the end of the day, this really doesn't affect me too much because I don't really care about LPs anyway, but I'm just throwing my two cents in as well

My main problems is it can be robbing you of an experience of playing the game itself. To me it is like taking a movie and posting your commentary track over it and then posting it online and making money off of it. Games are meant to be played through, and just watching them through as if they are a movie can devalue the games industry as it may make the bean counters think that is what Video Games should be slightly interactive movies.
To a degree, that's sometimes what you want. I'd very much want to be robbed of my experience watching Attack of the Clones. If I could just watch the first 20 minutes commented over, I'd probably be happy to do that. If anything, it creates more transparency in the market and allows for more competition.

That's already happening to some extent. Youtube is one of the few ventures where ad dollars can still be a sustainable revenue source. Many online publishers start putting content behind paywalls/resorting to donation funds due to struggling with ad-based revenue.

First, I don't know why everyone is assuming that this means that Nintendo will claim videos not partnered with them. This could easily be a business move to make a bit more profit from YouTube among the people who choose to use Nintendo's network.
Second, while I personally am unsure about this, the side of the argument in favor of keeping story and cutscenes is that in games like RPGS, it keeps everything together. They put everything the LPer is doing in context, and make the LP as a whole more watchable.
@TingLz Do you have a source that remixers have to pay royalties to Nintendo? Anyway, Fair Use is a broad term. Some things are fair use as long as you don't make money from them (I can record radio legally because of this), others are fair use if you pay a royalty, and others are fair use whether you are paid or not (parodies and reviews both fall here.

You do understand that the ads are necessary to keep the site free, right? Not all of them are for the content creators.
A company as big (and as crappy) as YouTube/Google can't run without constant trails of money due to their size.

Some remix albums I purchased are produced by a company that specializes in licensing. I know for sure that the law does not permit 100% royalty free revenue from songs that are remixes or too similar to other songs.

Oh tell me about it. I kept pestering Ant about one ad that kept crashing my browser. Coincidentally, it also made me learn how to block videos on all websites by blocking all plug-ins. Still ads are still permitted but auto-play videos are blocked

But if I do ads, I can use the money to pay for better recording equipment (theoretically. I'm not a YouTuber) and generally make my videos better. When other companies allow me, and even encourage me, to make YouTube videos of the game, it comes across as stingy for Nintendo to demand money from the video's creators.
My SD Card with the game on it is just as physical as your cartridge with the game on it.
I love Nintendo, that's why I criticize them so harshly.

Or you could just pay your stuff from a regular job. Besides, if you were to start an LP channel, you'd have to invest in your ewuipment in advance, or you'll have serious issues getting any attention from viewers. And if your videos are popular, there's no need for better equipment, since what you have is good enough, in that case.
Now that I look further into it, it doesn't seem like that good of a deal. Somebody like PewDiePie really isn't effected by this either way (4 million dollar salary and all,) but others could be unreasonably hit hard because with MCNs that means 3 different parties take the money before it gets to the creator. And that's just awful.
Nintendo should probably go with MCN licensing contracts because the registration system would be easier for all parties and Nintendo could potentially squeeze more money that way. But even that sounds like a terrible idea rep wise.
This whole debate is annoying as hell. My position is simply that the world is a much better place if as many people can make a living in as many different ways as possible.

Holy crap! Finally, I can watch those "Wii Street U Powerd [sic] by Google", "Wii Fit U" and "Yoshi's Safari" Let's Plays I've dreamed of.
Just watched the TotalBiscuit video. This is destined to fail - no-one is going to be stupid enough to sign up for it (not that they'd be able to play any interesting games like Fantay Life or Hyrule Warriors anyway...). Nintendo will be stubborn about it though, and they'll probably content claim every Nintendo video on the damn site.
A part of me is hoping they are stupid enough to target a fair use/review video on youtube (like one of TB's videos), then the proverbial will really hit the fan.
While I'm defintely not a fan of the trouble Nintendo might be causing some long-running YouTuber's like chuggaaconroy, I still don't have much sympathy for the ones who complain about this.
