I can't say I know the answer, but where do we draw the line with such jokes? Such jokes are made all the time, a lot have less proof that they are jokes, but the people behind them don't get in any trouble. Where you draw the line is a complicated matter, but he should get off really lightly since when they looked at the matter it would become obvious that he wasn't serious. He doesn't need any more punishment to learn his lesson. Is it right to make an example out of him? There was no common sense involved here. It's literally immposible to check out every possible threat, so picking up one at random doesn't make much sense espcially when it obviously leans heavily on being a stupid joke. They decided to pick on this kid despite it being against commen sense to do so, and look how it turned out. He has been in jail for months now because he got randomly picked out of the millions of jokes on the internet. There was no logic behind this.

it is not a 'minor grammar' detail. it is the difference between thinking of doing something and intending to do something. one is an actual threat the other isn't.

If someone is seriously thinking about commiting muder is should be responded to as quickly as someone who plans becuase you don't know when he might to decide to do it. You also have no way of knowing if he is planning to do it and he just worded it funny. Judging the seriousness of threat like this over minor grammer details is a bad idea.

It was sarcastic. It was a stupid comment, but potentially 8 years? That woman who reported him was stupid. Who doesn't know obvious, blunt sarcasm that references recent events. He should just get a temporary ban for his idiocy. This is just wrong.

Honestly with the amount of school shootings we have been seeing lately I think the police were right arresting this teen. Think about it if this wasn't a joke and he said that and nobody did anything and he did go shooting up a school. Honestly what he got is fair maybe next time he will learn to keep his mouth shut and think before speaking.

I have two sides to this: first being that the first amendment does NOT grant you permission to say whatever you want without consequence. Secondly, these authorities are seriously going overboard with the punishment. His words do not warrant eight years behind bars when he was clearly being stupid. A slap on the wrist and some jail time could have easily fixed the problem.

@Alex: I can vouch for k8. I was used to the quote button being on the far left before I became a mod. Now the edit button is on the far left on all posts instead of just my own

Absurd, they have to be joking. Maybe trying to scare people with the news but won't eventually lock the guy up. 8 years for this, really? Any time at all, actually, is pretty ridiculous. Give him community service, he'll learn it.

Are they gonna lock everyone that says stupid jokes up for 8 years? Are they gonna raid the entire internet or is this kid going to serve as the example? I don't know how someone can support this.

I'm going to step infront of the bullet here. I've made some fairly grusome comments every now and then such as.

"Flingsmash is easily one of the worst games out there. The Motion+ loses calibration constantly, the game involves repeatedly flicking your wrist, and listening to that yellow thing make any type sound makes you want to brutally murder a kitten and baby panda."

I had almost forgotten about this game. I'm already becoming burdened with anticipation and excitement. Why did I open this thread? I'm going to go nuts waiting (lets hope my decreasing sanity won't result in me killing my wife in front of my son causing him to be brainwashed of that moment )(To clarify to anyone who doesn't know this is a FE reference, no need to be disturbed. I'm 14 and, of course, have no family). On a more positive note, I can't wait for this game and will be buying it day one.

Not nearly as disturbing as his comment, but still should I go to jail for making comments involving murder, even though they are not truely meant in a literal way (one being an expression of annoyance and the other a video game reference). Simply run some phychological tests, smack him on the wrist, and then do whatever is best based on the tests. It would be much more effective.

So he used his real name on Facebook and said the comment? It would be more disturbing if they tracked the guy's IP. Seems like a First Amendment issue. It was free speech. If there was a clear and present danger then it will not apply, but following investigation, if the Police are satisfied there was never any intent and that it was a joke, there is no case here.
