Nintendo sells the consoles to Sears, Sears sells the consoles to customers. Nintendo had nothing to do with Sears price at $60, and other stores matched the price. The other stores matching it is proof that those stores were willing to go that low of price, so people got Wii Us at $60.

If Sears wanted to sell the Wii U for $30 they could. They are taking a loss on their own profit margin. Do you think every time a store puts a Nintendo product on sale, they pick up a telephone and call someone at Nintendo to ask for permission first?
Sears will either cancel the transactions or honour them at their own discretion.

If you paid $60 and made it out of the store with your console, you are safe. They can't make you come back and return it, nor can they illegally make a second charge to your credit card. If you ordered online however, and the item has not shipped yet, it can be cancelled and charges on your Visa will be reversed.
Ya. I bought a center speaker for $80 from somewhere on Amazon, then I told them I want a refund while it was being shipped. They asked me "why?", and I said another store had it at $61, which was true, so they said they would match the price.
EDIT: I got the lower price, while it was being shipped. That ensured that they kept that money.

Did Nintendo not stop the US part of Amazon from selling hardware because they wouldn't stick to the RRP. (I think Apple is similar even in the EU which I don't understand - obvious tactic to be the cheapest but make less per unit on a much larger volume).
I know it is different in the EU because of the fine Nintendo got for price fixing.
(Tesco when I got my Wii U was £40 less than anywhere else but to my knowledge they haven't done anything similar with Apple stuff ever but they have with almost anything else).

What happened to me is probably why Nintendo won't sell as a store to amazon. Just imagine if Nintendo was "fullfilled by amazon". Nintendo can sell cheaper consoles by refurbishing them, so that's Nintendo's way of selling their own consoles. It's still guaranteed by them.
