I assume Sears will charge those people's credit cards $140/$240, so they'll have to pay that or return it.

The first case of negative store credit.

That's illegal, because they already swiped the card at the $60 price.

But it's a price glitch, they weren't legally selling them at $60, the computer made a mistake, so Sears would have to notify the buyer that the price they paid was incorrect.

They'll just take the loss.

If the compter made a mistake, then they need a better computer/printer. If the person typing on the computer made a mistake, they need to tell that person to try avoiding the mistake, next time. They were legally selling 3DS systems Wii U systems at $60 each, because that mistake was made.

No, for them to legally sell Nintendo products at $60, Nintendo would have to allow them to sell it at that much. Obviously Nintendo didn't say they could sell the consoles at $60, so it's not legal.

@Dipper723
Nintendo sells the consoles to Sears, Sears sells the consoles to customers. Nintendo had nothing to do with Sears price at $60, and other stores matched the price. The other stores matching it is proof that those stores were willing to go that low of price, so people got Wii Us at $60.

If Sears wanted to sell the Wii U for $30 they could. They are taking a loss on their own profit margin. Do you think every time a store puts a Nintendo product on sale, they pick up a telephone and call someone at Nintendo to ask for permission first?

Sears will either cancel the transactions or honour them at their own discretion.

lol @ thinking a store selling a product at a lower price by mistake is somehow "illegal"

@SCAR392: They can also cancel the purchase due to the glitch. A purchase is not set in stone all the time

They have a printed receipt. It's set in paper.

I think @SCAR got you there!

If you paid $60 and made it out of the store with your console, you are safe. They can't make you come back and return it, nor can they illegally make a second charge to your credit card. If you ordered online however, and the item has not shipped yet, it can be cancelled and charges on your Visa will be reversed.

Ya. I bought a center speaker for $80 from somewhere on Amazon, then I told them I want a refund while it was being shipped. They asked me "why?", and I said another store had it at $61, which was true, so they said they would match the price.

EDIT: I got the lower price, while it was being shipped. That ensured that they kept that money.
EDIT2: I got refunded $19. It was like a mail in rebate, except the package was coming to me.

Did Nintendo not stop the US part of Amazon from selling hardware because they wouldn't stick to the RRP. (I think Apple is similar even in the EU which I don't understand - obvious tactic to be the cheapest but make less per unit on a much larger volume).

I know it is different in the EU because of the fine Nintendo got for price fixing.

(Tesco when I got my Wii U was £40 less than anywhere else but to my knowledge they haven't done anything similar with Apple stuff ever but they have with almost anything else).

What happened to me is probably why Nintendo won't sell as a store to amazon. Just imagine if Nintendo was "fullfilled by amazon". Nintendo can sell cheaper consoles by refurbishing them, so that's Nintendo's way of selling their own consoles. It's still guaranteed by them.
