I'm posting this here in the hopes that it will garner some attention, which in turn may garner the attention of someone at Nintendo.
Let me first say that I generally like Nintendo - they make good games that I enjoy, and I trust their games to be of high quality. They own many franchises that I personally enjoy a great deal. What I am about to share does not change that.
That being said, I must share my thoughts on their most recent actions regarding the fan series Super Mario Brothers Z, by Alvin Earthworm.
This is one of those times where the bloke responsible should be thinking "It was nice while I got a way with it" as opposed to thinking "Aw man this ain't fair." All I watched was 2 minutes 31 of an overgrown kid throwing his rattle out of the pram.
I never drive faster than I can see. Besides, it's all in the reflexes.
First off he did because he thought he could get away with it. Second, He didn't bother contacting Nintendo about it to see if there was something they could work out. Third, As you said Nintendo owns this, if they didn't defend their IP, including complete use of sprites from the Mario and Luigi series isn't something that should be done. Fourth, I want to see people start putting up games on Steam using Nintendo's IP and sprites with your logic being used, there is no reason why with your argument that Nintendo should oppose it as it is something made by the fans so it is good for Nintendo.
I am not pissed off about Nintendo not wanting somebody from making money from Nintendo's work. I completely understand what the guy was trying to do but going with the F*** Nintendo and make Nintendo beg for forgiveness is not the right response. Saying that Nintendo has to be one to reach out to him is completely backwards, it needs to be two-way.
A popular online fan series that sees Mario & Luigi teaming with Sonic & Shadow to collect the 7 Chaos Emeralds before Bowser & Eggman or Metal Sonic (who's gone rouge) can, to save the Mushroom Kingdom. It uses spritework both from previous games, and fanmade, with the action being heavily inspired by Dragon Ball Z (with one attack, Metal Sonic obliterated Yoshi's Island, for example). The music used is also a bit of a mix between Mario, Sonic, and DBZ stuff.
It started off years ago ('05 or '06?), but he dropped the project around '09 or '10 after about 8 episodes, until he suddenly recently resurfaced with this crowdfunding effort to revive it from the ground up.

Eh, he's got a new patreon now, and it doesn't explicitly reference Super Mario Bros Z or other fan works. So I'm not sure this takedown is really an issue any more.
