i'm all for setting these pirates straight but 1.3million $ for a single person is just wrong. it's not a company who made money off that rip, he just took his game, made an image of it and sent it off into cyberspace. they sold what 10 million new super mario bros? we're talking pocket change for nintendo, and man's financial future destroyed for it. that is if he's actually expected to pay off any of it and it's not just setting a presedence for future cases.

The man gave away thousands of copies of the game for free, which he didn't own the right to.

And yet by doing so it makes others a hell of a lot less likely to try to pirate Nintendo games. Once you know that they're willing to sue a single person for that much, you're somewhat less inclined to do it yourself. A 'no trespassing' sign will be ignored by some, but stick the head of the last guy who went through on a pole next to the sign, you're not gonna get any more trespassers. Sucks for the first guy, but hey, there was a sign.

He allowed others around the world to pirate the game. We're not talking a few people. Besides, this is good because it will serve as a warning to other piraters! probably not, but I'd like to think so.
Just let it happen.

Well, claiming they have lost thousands of sales is probably a bit of a stretch. A big percentage of those downloading probably won't have bought the game anyway. Still it is wrong and I don't feel at all sorry for the guy. But unless he is somewhat rich, Nintendo will probably not see any money from him.
I think that this kind of precedent is important to set. I feel Nintendo can set whatever compensation value they want, as there's no realistic way to know how many sales were really lost. I'd much prefer this kind of anti-piracy tactic to that invasive DRM crap.

The sad thing here is the guy is not a pro pirate, he's just someone who got the game sooner them everyone else and released it before the the Real pirates (you know who they are). Apparently, he was not aware of the rule #1: don't get caught (Dexter knows it). I'm pretty sure his act did no harm to NSMB Wii sales at all, but the law is the law...
