Of course it's up to the publisher. The 3DS and the Wii U are very different devices, so I don't think porting is easy. Perhaps some even oursource their ports to make that process faster. So why wouldn't they charge us for their hard work or try to get the invested money back?
Isn't that also more like a promotion than actual cross buy? You have to buy the 3DS version to get the Wii U version for free. Cross buy would give you the other version for free no matter which one you would buy first.

From what I've seen people will buy games quicker when options like cross buy are available as it feels like better value for money instead of waiting for sales.

Buying a version gets you another version on a different system in the same ecosystem that is cross buy so yes this is cross buy.
How people feel doesn't change the fact that porting probably was a lot of work and whether they want gratification for it or not should be up to them.
To me it's a promotion. I only have a Wii U, so if I buy the game on the Wii U will I also be able to play it once I get a 3DS? No.
@Rin-go Well I see this as good thing for consumers and something that should be an integral part of the VC system at this point and if the publisher is allowing it it obviously makes financial sense to them as well.
lol someones still going to find something wrong with this, it simply wont be enough. its gonna plant a tree that branches out complaints.
